Hello Everyone,

I am writing in behalf of My dad (who is my petitioner) His I-751 has been pending now for over 4 years, For me and my brother our I-751 has been pending for 2 years. My dad is petitioned by my step mom and up to this point they are still together, both of them have been called for an interview TWICE after my dad filed for I-751 the first interview was 3 years ago and the 2nd interview was 2 months ago. I am very concern about our case, I am worried that we might get a Denial. I am currently in college attending a private university, I have a government loan that is over 100K. I know that we are under my dad's umbrella. so if he gets denied, we are going to be denied too and I am afraid that they might have us deported if this happens.

Questions:

1. Is there any action we should do by now? -- is this a rare case? or this happens to many applicants?

2. If ever we get a denial, I was planning to apply for the deffered action for childhood arrivals. will that work out for me and my brother?

3. What about my dad? Can I still petition him, If I'll have a chance to fix my papers in the future?

Please help me regarding this issue. Thank you so much!!

Why didn't your dad send in N-400 a year after the I-751 has not been approved? That makes them adjudicate I-751 before they're done with the naturalization interview.

Did dad and step mom get in touch with their local congressman/senator? That can bring results in form of USCIS telling them what's the problem with the case.

Don't wait anymore, get hold of your congressman and ask them for help. They can do something about it. By the way you can take them to court to and have a judge decide since they took 4 years with no decision

file for N 400 for citizenship. It seems like somebody is slacking hard there.

Thank you all for your reply, weve been getting stamps for years now. But it held me from so much oppurtunities to travel abroad:(

Anyway, will n400 speed up the process?

My dad was saying that he didnt even bother to apply for n400 because they had a second interview after 3 years which makes that 3 interviews in total, the first one was for the green card approval the second was after he filed for i751 and the 3rd one was 2 months ago after 3 years!

Thank you so much for your reply! Yes my dad sent a letter to the congresman but he didnt get any reply. Do we have to go to the office? And seek for help?

Holy Molly, I think we have a new record here for pending I751 here on VJ.

Yes, file your N-400! At the same time get hold of your congressman and seek help. Also I hope you have I-551 stamps done in the past 3 years to extend your NOA status.

Ive been looking through the blogs too and ive never seen anyone who had thier case for over 2 years or 3. This situation really held me form so much oppurtunities even though weve been getting 1-551 stamps. .

She was petiioned by my stepmom who is a US citizen.

So, everyone was petition by the stepmother\wife. When you first arrived you arrived as CR1 and 1r2 correct.

No divorces or annullment on eitherside

Yes thats is right!

Okay, the husband can file for citizenship after 3 years of being married to the orginal petitoner.

The children if age is greater than 18 can file after 5 years. The children's petition is separate from the fathers if relationship is still married.
