More questions as well: So, you had a civil ceremony in the US on Sept. 12th, 2011?

What "events" happened in your home country in June 2012?

The religious marriage is only religious, it's not a problem if it's done before your civil marriage. The date of your marriage that the USCIS is interested in is the date where you got civilly married (which should reflects on your marriage certificate). You will have to provide a copy of your marriage certificate in your package.

Dear

Nikha held on 10th sept 2011 in United States of America with 250 guest in Banquet Hall with Imam who sworn the nikah , After two days we got marriage licence on 12th sept 2011 which valid for 30 days .

The question arise that all Muslim religious event occurred in my native country called Pakistan on 28th June 2012 Ten months difference ( where is marriage licence validity gone) .

How should i explain the discrepancy to uscis or uscis accept my discrepancy ,as i was not aware of law of land.

please give the solution.

Same topic is here: http://www.visajourney.com/forums/topic/396446-petition-i-130-i-485/

No need to create a new topic to say the same thing twice. Plus you got some answers in your first topic.

I replied to your first topic but now that you stated things differently, I have a question for you: you said that you had a marriage LICENSE in september 2011, but did you use it and got a civil ceremony in the US? If not, and so, you don't have a marriage CERTIFICATE, you are not married to the eyes of the US. You are "only" religiously married, not civilly, and so, can't file for AOS!

A marriage licence is a permit for you to get married civilly. That's why it has an expiration date. You are supposed to then use it during the time of its validity to get married in front of a law representing person, which then delivers you a marriage certificate (=proof that you got married). The marriage certificate doesn't expire!

Just an addition here, a marriage license is not only for a civil marriage. It is permission to have a legal marriage. Most religious authorities that perform marriages are qualified to sign the marriage license after a marriage is performed, which then can be turned in for a marriage certificate.

So, a couple can get a marriage license, be married by a religious authority who signs the cert and attests that a marriage has been performed, and then that paper is turned in to the civil authority. A civil marriage is not a requirement to be married in this country. The religious ceremony and the civil notification is all tied together, if that is how you choose to do it.

A marriage license obtained after the marriage ceremony has little use (as in the Op's case)

That's good to know, thanks for correcting me Harpa Timsah. A question is still hanging: does the OP have a marriage certificate?

It seems to me that they have a marriage cert from Pakistan, but who knows. The OP also hasn't returned to the thread. What is for sure is the marriage license they got has nothing to do with events in Pakistan. Why the OP thinks so, I am not sure.

Dearest Harpa Timsah

DISCREPANCY IN MARRIAGE CERTIFICATE DATE

On 1st may 2012 We got interviewed & officer put red flag on my file as I showed nikah invitation card (religious ceremony conducted by authorized Imam (Preast)on 10 sept 2011 starday ), Sunday (holiday)

Marriage certificate obtained on 12 sept 2011 , I made mistake show up my pic nikah invitation card dated 10 sept 2011 and marriage certificate Dt 12 sept 2011 USCIS objection on dates , meanwhile we arrived our native country to do all culture events on 28 june 2012 after that our marriage consummated.

On interview date we were not cohabitate due religious constrain . now again I will file new application with full proof as my petition i-130 & i-485 denied (reason immigration purpose )

I did face consequence to telling truth to uscis the exact date of my nikah (religious ceremony )

Your advice needed how to get waiver on this mistake or give any affidavit to uscis or take new marriage certificate according to above events occur in Pakistan .
