Applying fcr advance parole to travel before receiving green card

Timeline

My husband and I want to spend our first anniversary in Scotland with his family and friends, most of whom could not make it to our wedding in the US. Also, my parents and possibly my siblings are coming as well since they have never been to Scotland and would also like to meet the other family members. I'm filling out the I-131 but have a couple of questions:

1) what is the class of admission?

2) what if we don't know the exact date of departure? We know it will be in March but don't know the exact date yet.

3) How long does it usually take for this to get approved/denied?

3. 3 months to be approved. AP is routinely approved for people with I-485 pending.

You do know that this all goes together with your I-485 packet, yes? You cannot file the I-131 separately.

3. 3 months to be approved. AP is routinely approved for people with I-485 pending.

You do know that this all goes together with your I-485 packet, yes? You cannot file the I-131 separately.

I was told by our neighbor (who used to be an immigration attorney) that you can, there will just be a fee for it, whereas if we had done it along with the packet, it would've been free. And thanks for the info!

You may want to read over the instructions for this form. Yes you can just pay the fee, however from what it states as far as who can apply for this it also says that you have to be a permanent resident, or have conditional residency, or have a pending I-485. So although you may have gotten married in the 90 days to meet the 90 day requirement for the k-1 visa. There is no residency as of yet because you have not applied for it. So you may get denied. Just a thought why pay $445 almost half of what it is going to cost for the AOS and this form is free, to then turn around and still have to $1070 on top of the $445. Best of luck to you which ever way you decide to go.

There is no fee if you have filed for AOS. Just include a copy of the NOA for the AOS with the application for advance parole.

If you have not filed for AOS, I don't see what basis you would have for applying for advance parole.

You can file I-131 separately but ONLY with a pending I-485. You don't pay the fee as long as you include a copy of the I-485 NOA1.

There is no basis to approve the I-131 without the I-485, as explained above.

You can send it in after, but not before the I-485.
