October 2012 AOS Filers

Ok that makes me feel better! Hopefully it'll be a short wait! Also have you guys been able to get drivers licences? If so how did you guys do it

Hi marl - my guy has his driver's license but the procedures are different by state. In the state we live in, he needed a social security number, his passport (with visa in it) and a birth certificate. Some places might not understand how a K1 works, so ask to see a supervisor, if necessary. Check out your state's department of motor vehicles website and it should tell you everything you need. Some states I don't think will give you a driver's license until you show an EAD or have the full green card. But, for the record, my guy said his driving test was SUPER easy. Good luck!

Thanks! I think I'm gonna have to go back and talk to a supervisor. Online and on the phone I was told I could do it with the ssn and visa but the guy there kept telling me I couldn't. Guess ill have to try again!

so I got the package returned in the mail today... rejected based on the fees-either incorrect amount or not included.

I included two checks; $420 for the I-130 and $1070 for the i485. My understanding was that the i485 fee also included the AP and EAD application/petitions... I cannot work out what I did wrong... I will call them on Monday but does anybody have any ideas? :(

just realised that I incorrectly dated the checks, I did day/month/year instead of month/day/year.... could this be why?

Yup, thats why. you need to re do the checks and send it off ASAP. maybe you can express it since you lost so much time already. good luck :thumbs:

so once i put the baby to bed i realised that i made out the check for 1040 instead of 1070.... :huh: No idea how i managed it....I blame baby brain.... at least I know what the problem is. Putting it all back in the post today. There is a brightly coloured paper included that says to put it on top of the returned packet for special consideration so hopefully it wont throw us too far off the track. Will update when there is news!

Hi! I called USCIS today right after my guy's biometrics appointment and here are the updates I can give:

- As soon as I read off the case number, the USCIS woman said, "Oh! You aren't in the online system yet, is that why you're calling? I've had to forward a lot of those calls today." I said, "Yes, partially, whats the deal with that?" Then basically she just gave me the explanation about how it's a relatively new number and just not online yet, that if I received the NOA1 in the mail then I'm fine, etc. So, no updates about the online case status, just that the government hasn't gotten around updating it. You'd think for how much we're paying, they could hire someone for minimum wage to do some basic data entry? Oh well :)

- The second reason I called is because of some confusion after the biometrics appointment. I should've done more research about the EAD/AP combo card beforehand, so I guess it's my fault, but here's what happened. When we got to the Biometrics office, the receptionist woman said, "OK, applying for work authorization and a green card?" And we go, "Yes, and advance parole for travel too." And she replied, "Well that's not what your appointment letter shows. I can only do biometrics for work and green card today." We brought the three NOA1s with and showed her and she goes, "I see. Well, you'll have to call the 800-number and go by that, but I can only do biometrics for your work and green card today." So we were like, OK, that's annoying, we'll just have to come back for the AP then, but OK, let's get this done. Biometrics were over in 15 minutes so no big deal there.

- We get home and call the 800-number. The woman explained that the EAD and AP combo cards are relatively new and that not all field offices know about this yet. She said that only the EAD is listed on the biometrics appointment letter, along with the green card, but the AP is processed simultaneously, just not noted on the paper. She assured me that we don't have to come back, etc. So, I'm glad I called, but it could've saved us a lot of confusion if the woman at the biometrics office told us about the combo card in the first place!

I'm glad that part is over though and now we just play the waiting game :P I'm assuming we just get the EAD/AP combo card in the mail in about a month or two, right?

Yes, waiting is tough even now when you feel like you and your loved one are in limbo-land. :blink: How long from NOA to setting the appointment for biometrics? Does it just vary depending on local office? :luv:

In my case biometrics appointment was 2.5 weeks after NOA1, I think it's pretty standard. You might try doing an early walk-in if you don't want to wait, lots of offices allow you to do that, including mine!
