Greetings!

I sent in the papers for C-130 beginning Sep. I am trying to become a permanent resident.

My wife and 3 kids (american) are leaving to USA for Halloween.

I will stay in Sweden and wait for my green card / K-3 Visa.

This weekend I applied for K-3 Visa hoping that will bring me quicker to USA.

Will the "Visa processing people" look at my family situation and prioritize my case since my family is separated?

Or am I facing the same processing time as everybody else?

In addition; I have previously lived 3 years in USA on a perm res permit, will that speed up my case also?

Afraid I will have to wait a looooong time :(

THANKS!

Thomas

The K3 really doesn't exist anymore. It is no longer a speedier option. Typically it is closed in favor of the I-130 petition.

You had a green card before?

Why are your wife and children leaving you?

Do they have dual nationality?

I believe the processing time will be the same for as for everyone else. Having your family separated will not expedite your case. But that's just a guess.

If you're applying for IR-1 and the US citizen is living abroad there is a good chance your case get expedited in the USCIS. In my case it took two weeks instead of five months. Now we're waiting for our interview. It took 42 days for our case to be completed with the NVC.

Most of the people applying for spousal visas are separated - your situation is same as majority of others out there.

Thank you all for your support!

"If you're applying for IR-1 and the US citizen is living abroad there is a good chance your case get expedited in the USCIS. In my case it took two weeks instead of five months. Now we're waiting for our interview. It took 42 days for our case to be completed with the NVC. "

That sounds promising. Yes I am applying for IR-1. Did anybody else experience this or was it pure luck?

"Why are your wife and children leaving you?"

She can not stand it here. 40y old crisis. Missing home type thing. Too cold. Too socialistic...

"Do they have dual nationality?"

Yes. Swedish and USA.

"You had a green card before? "

Yes. 5y ago. I had it for 3 years then we moved back to Sweden.

"The K3 really doesn't exist anymore. It is no longer a speedier option. "

Bummer.. guess I just wasted some time filling it out.

Thanks all of you!

Having the families separated would not make you eligible for the expedited process. All the families that go thru the process has to go thru the separation so you do not have any special circumstances.

You can always try to expedite your case, there is nothing that stops you from doing that.
