O I'm sorry I was unclear...It isn't going to be on an H1-B. She is going to be brought over on a traveler visa and then they are going to apply for a marriage visa. See he hasn't met her yet..They met online so he is trying to get her over here to meet her and get married. But before she can come over she says she needs land, a credit card etc. I think she is from malaysia...I'm not sure though I'll ask him. But does this ereally sound legit for a normal travel visa/marriage visa?

From what I have read, this is not the way to do this. If he wants to bring her to the US as a Fiancee, he needs to go through the K-1 process. If he wants to bring her here as a wife, he needs to marry her then bring her here on a K-3. Bringing her here on a tourist visa (which probably has a low chance of success anyway), marrying her then filing for a K-3 is definitely frowned upon by the USCIS. He will probably end up either (1) married to a woman who is an illegal alien or (2) married to a woman living in Malaysia who has a very hard time getting a K-3 visa or (3) filing a K-1 after a failed tourist visa attempt and trying to explain that in the petition and at the interview (this is the most likely outcome and it will at least delay her arrival in the US).

I am no expert on this, it is only my understanding from what I have read. If he wants to marry her, he should choose either the K-1 or the K-3 route. The tourist visa is not an acceptable alternative or shortcut.

It is possible to marry whilst on a tourist visa.

America will not allow 3rd world country citizens to visit the USA unless they can prove that they have a reason to go back to their respective country. I think for the Philippines you have to own land and have a large amount of money in the bank. If not for this requirement, anybody and everybody that could afford a plane ticket would be over here. It's sort of a population control. It's sad but true.

If this family member is serious, then he should get on a plane and visit her. The problems of buying property just to show permanence is too risky. He needs to have proof they have met in the past two years for the K-1 so why not make it a nice trip to her country. If after meeting he still feels like getting married, then he has the K-1 route, which is still the best method.

It's important to also get an understanding of her life and culture. He should not expect that she will instantly like America and easily adapt to life here. On the surface this definitely sounds like a scam, so advise him to use care. He can get a lot of advice from people here about various scams.

To do a tourist visa as evidence of meeting ( even if she intends to return until K1 ) is

a waste of money and time as she will be more than likely denied.

Tourist visas are a joke for most countries, especially for developing countries.

My fiance has a daughter in school, house, land, money in the bank and numerous other ties and still was denied

when we wanted to initially meet.

So he needs to go visit her as others have said. Then they can decide if they want to do K1

or K3. But really, tourist visas are a joke, why not just close them for certain countries

instead of wasting peoples time and money and deny them even though they have all proof

that is required. But let me get off my tourist visa soap box !

What? This is making no sense to me. How would that not be visa fraud even if they got married? What the hell are all the Brits and French and Germans doing waiting for a K-1 visa then? Why don't they all come over on a their VWP and get married?

The only time this would work is if one actually did come over just for tourist reasons and then actually met someone here and decided to get married. If they knew before hand they were going to marry, then that would be material mis-representation--it would be fraud!
