Administrative Processing due to No Criminal Backround, how long will this take?

Hello Fellow VJers,

We had our interview on Aug 28, 2012, my fiance was told to give them 3 weeks and we should hear back from them either he'll get his passport with the visa or a letter explaining of what needs to be done. Does anybody have any experience on this kind of delay? How long will this normally take? Can I call any offices? Is there anything we can do to expedite the process. Or just any experience you guys went thru just so I can have an idea what to expect.

We were in ap also, there is no time limit and really no phone calls will speed it up, it usually lasts a few weeks. was there a 221g given?, if so what was checked on it?

10/19/2010 - NOA1 hard copy received, dated 10/15/2010

04/08/2011- received NOA2 hard copy, dated 04/05/2011

04/12/2011- NVC received petition

04/18/2011- received letter from NVC

04/18/2011- Manila embassy received petition

04/27/2011- medical exam passed

05/04/2011- appointment letter received dated 06/01/2011

06/01/2011- appointment date, put on administrative review

06/24/2011- visa granted

06/29/2011- received visa

07/18/2011- cfo class

07/21/2011- arrived in America

09/02/2011- happily married!

AOS Timeline

12/01/2011- AOS packet sent

12/06/2011- received email and text from USCIS with MSC number

12/07/2011- check was cashed

12/10/2011- received NOA hard copy dated 12/05/2011

12/12/2011- received NOA hard copy for biometrics appointment for 12/28/2011

12/24/2011- received NOA hard copy stating that our case was transfered to CSC on 12/20/2011

12/28/2011- biometrics appointment completed

06/25/2012- put in service request

09/12/2012- AOS approved

09/17/2012- card production

09/21/2012- greencard in hand

ROC Timeline

08/04/2014 - sent ROC packet

08/13/2014 - received I-797, NOA, dated 08/08/2014

08/28/2014 - received biometric appt. letter for 09/11/2014

i believe this has something to do with his NBI Clearance.

usually, if one doesn't have any criminal record, NO RECORD ON FILE is written on the NBI Clearance.

otherwise, NO CRIMINAL BACKGROUND is written, that's why he is put under AP.

the Embassy will have to double check his records with NBI.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The only thing that was written/checked on the paper that was given was his NBI clearance. What was the issue on yours? How long did yours take? Thank you

Thank you. I really hope it would only take weeks. We already waited 3weeks, that's what the Filipino officer said, give them 3 weeks and he should get his passport delivered with a visa or if not a letter. The hard part is we don't know if it's approve?

An official letter of explanation from the NBI is required for any notation of “No criminal record”, or "No pending case”. The US embassy just want to find out more about the non-criminal record under his name. If you were told to wait 3 weeks and 3 weeks have passed, it's better to start following up with the US embassy. You'll most likely get an approval as soon as the embassy receives the explanation.

Just to keep you guys posted...I had a very long 4 weeks of waiting.

Our 3rd week of the interview date was on Sept 18, haven't heard anything. I called them on Sept 20th, I called US embassy and DOS, both told me that our case was on AP and can't tell how long that would take.

So, decided to wait.

Sept 22, my fiance recd a call to ask if he will be at the address where he wants his passport delivered. Being it was a Saturday, their office as closed so he wasn't. and so the delivery guy said he'll deliver on monday. Whew!! this was the longes 2 days of my life--feels like at least. Then on Sunday we recd this email:

Dear XXXXXXX Xxxxxxxx

Your document(s) have been collected from the US Embassy/Consulate.

The passport number being returned is AB1234566 and the AWB for tracking is S123344555L.

You have chosen to have your documents delivered to the following location:

DiLeonardo Inc.

Unit B, 6th Floor, MAKATI CITY, METRO MANILA 1203

If you have any issues or concerns, please contact us at www.ustraveldocs.com/ph.

Oh my!!! I kept reading here at VJ, read abt being put in AP for longer periods of time when they got this letter and some got a visa. my oh my!!! I guess I will just have to wait.

We got our visa today!!!

most cases at USEM-Manila takes a month or but less than 3months to approved AP cases..compare to different country i.e pakistan takes year/s to process it.

by the way congrats :thumbs:

The longer it takes to happen the more you'll appreciate it when it does!
