Hi a guy, quick question is it possible to AOS after 90days since he arrive the US?

For example he arrived in the US Oct. 10, 2012 get married Oct. 20, 2012 then adjusts his status around Feb. 11, 2013. is this okay? advice please :thumbs:

Yes. After marriage, with certified marriage certificate in hand, you can file for AOS at any time... the same day (if you have all the papers) or the morning after. There is no deadline or minimum time to wait to apply for it good.gif

Hi,

I was under the impression that you had to file for AOS within a certain time frame in order to stay in legal status...is that wrong?

Technically, it is not wrong but rarely enforced for alien spouses, and there are waivers if legal implications were pursued. Unlawful presence can be accrued and that becomes one's status. The goal is to AOS as soon as one can after marriage. Some have gone a year or more due to whatever reasons such as financial for example because the fee is just over $1000, and they had no issues during the waiting. Don't fret too much about this, but keep in mind that a couple is expected to AOS as soon as possible.

I was under the impression that you had to file for AOS within a certain time frame in order to stay in legal status...is that wrong?

You will be here legally, without proof of legality.

Basically....if you don't file the AOS, then you have NO status in the USA. Hence, you should file as soon as possible for the adjustment of Status.

You only need to marry within 90 days of entry to the US in order to fulfill the terms of the K-1 and be eligible to file for adjustment of status. There is no deadline to file for AOS. You will be out of status and begin to accrue overstay when your I-94 expires. When you file for AOS, you will enter a period of authorized stay and your overstay clock will stop ticking. Once your green card is approved, the overstay you had accrued will no longer matter. People file a few weeks or months after their I-94 had expired all the time and have no problems.

You should file as soon as possible though. Besides worrying about being out of status, the foreign spouse cannot get a drivers license, work, go to school or travel outside the US and re-enter without filing for AOS and getting their EAD/AP or green card.
