Can someone tell me if my timing is good?

My wife was approved for k1 visa on 4/3/2012 and it expires on 10/22/2012.

She was my fiance at that time.

She entered the US on 7/02/2012 and we got married on 8/01/2012. I plan on mailing AOS i-485 on monday 8/3/2012 is that enough time for uscis to process her application?

There's no deadline for AOS, so I'm not sure what you mean about enough time for USCIS to process her application.

You had to get married within the 90 days period, and you complied; after that, you can file for AOS at your earliest convenience. good.gif

I am not exactly sure of your question, is it enough time to process her application. From what you have written you have met the terms of a 129-F by getting married in the 90 days from her arrival--there is no more "processing" done with it by USCIS. The AOS can be filed and it will be processed. Just make sure you have all of the required documents. It took me a week after getting married to get a certified copy of the marriage certificate to send with the AOS packet.

Really there isnt a deadline? Dont i have file within 90 days or when the visa expires? There is also a little paper they gave her when she entered the us and it has the date 9/29/2012...are you sure?

The visa expired the moment your SO entered the country. That visa is a one-time entry visa. She can't leave the country until she gets advanced parole. The 90 days is to marry, not to AOS. It is recommended you file immediately after you receive your marriage certificate so she can get the EAD and AP combo while waiting for her GC. So when you mail the I-485, please also mail the employment authorization and advaced parole paperwork.

As Phil also said, you have met the terms of a 129-F by getting married in the 90 days from her arrival and there is no more processing that needs to be done with it by USCIS

The i-94 give you the deadline to get married, that's what the date that the CBP officer wrote on it means.

So, pace yourself and take the time you need. After all the stress from the K1 process, you can breathe and gather ALL the documentation at ease.

Now that the AOS is submitted, your wife entered a NEW period of authorized stay. Any other scraps of paper she has with dates matter not. You did it right. :thumbs:

Edit; Oh, you wrote 8/3 but you mean 9/3. So, when you submit, what I said will be true (once it is accepted for initial review). The post office is closed on Monday, so I don't think you'll be getting your package out until Tuesday :)
