Hi All,

For those of you who have already completed the naturalization process, I'm wondering if any of you had your N-400 application expedited?

Quick backstory: I came to the US on a K1 visa. I'm an only child, and my parents live in Australia. They're in their late 60s and have no family around them.

We learned this week (Tuesday) that my father may have stomach cancer. We are waiting on the results to come back. I sent my N-400 application in on Monday. Talk about bad timing.

My question is this: If my father does indeed have stomach cancer, as his doctors suspect, is there any way I can get my application expedited so I can travel sooner? As I understand it, stomach cancer is one of the most aggressive forms and I wouldn't like to hedge my bets on my father being around until the application was processed over a normal time frame. That, and I obviously want to be there for my parents to support them during this time.

If it is possible to expedite it, what sort of documentation would I need? I imagine I'd need confirmation (sworn affidavit?) from my father's doctor and possibly from my mom?

If anyone could give me any insight into this, I'd appreciate it. I'm planning on calling USCIS in the next few days, but I just thought I'd ask in case anyone could throw some light on the process.

Our Timeline

December 31st, 2007: Engaged!

November 4th, 2008: Received official confirmation that first K1 packet has been received by USCIS.

January 20th, 2009: Received NOA2, confirming that the K1 petition has been approved.

February 10th, 2009: Kat receives Packet 3 from Sydney consulate.

February 18th, 2009: Medical Exam.

March 4th, 2009: Medical exam results received.

March 30th, 2009: Kat mails out Packet 3 to consulate (11:45pm!)

April 7th, 2009: Received Packet 4. Interview scheduled for April 21st at 9am.

April 21st, 2009: Visa Interview @ Sydney Consulate. PASSED!!! :)

May 21st, 2009: POE @ SFO.

July 11th, 2009: Married.

August 13th, 2009: Filed for AOS.

August 20th, 2009: Received NOAs for I-485 & I-765

September 19, 2009: Biometrics Interview

October 3rd, 2009: Received EAD card in mail.

November 24th, 2009: Received Welcome Notice & 2yr PRC!!

September 21st, 2011: Filed I-751 for 10 year PRC

July 3rd, 2012: Received 10 year PRC in mail.

August 27th, 2012: Filed N-400.

August 29th, 2012: N-400 Application received by Arizona service center.

September 4th, 2012: Electronic notice received confirming receipt of application.

October 24th, 2012: Biometrics appointment

December 19th, 2012: Interview letter received. Interview set for January 23rd, 2013.

I am sorry to hear about your father's health issues. However, it is my understanding that you can travel all you want during your n400 application process. You just have to be back for your bio and actual interview. You just have to deal with the financial ramifications of traveling back and forth.. I don't think there is a way to expedite your application. Maybe others can chime in as well.

It can't happen any sooner than late November (based on your signature timeline) when your 3 years of being an LPR is attained.

You don't need the US passport to go to your family. Your GC has a long time until expiry. You can obtain a reentry permit if you believe that your time out of the country could be quite long.

There is no penalty for withdrawing or cancelling your application. The worst that can happen is that you lose the filing fee.

Yeah if I were you I'd just postpone your application now (though I think you lose the 600 dollars) and focus on your dad. The application process is only about 4-8 months for most people and that amount of time is more important to spend with your family than waiting for an application (as people said you can travel during the process but you have to be around for the biometrics and interview, and you just don't know exactly when those will be). If you have someone who can watch your mail for you and you don't mind coming back to the US and back to Australia in short notices I suppose you can actually go back when you get notice of when your interview/bio is.

There is no reason to expedite your request for US citizenship.

You can travel into and out of the US with your green card.

Scheduling conflicts because you will be out of the country and your need to be here are not reasons that USCIS will expedite.
