Hello. I came to the state on a K1 visa. Sent all the documentation for I-485 and now I'm getting this:

I-693 Report of Medical examination and Vaccination Record.

Note: A review of the record indicates that you entered the US pursuant to a K-1/K-2 non-immigrant visa. All USCIS records related to you have been reviewed. The US Department of State medical forms DS-2053, DS-3024, DS-3025 and DS-3026 were not forwarded by the Department of State.

Please submit a properly completed and signed Form I-693. The medical examination must be conducted by a physician who is on the list of Civil Surgeons approved by USCIS.

The thing is I passed medical exams within a year of my i-485 application and everything was taken from me by the customs excluding the vaccination documentation worksheet (copy of the document) and the X-rays. I sent the Vaccination Worksheet along with all the needed documents for I-485. What should I do?

If they ask you to jump in the air 10 times and touch your noise you need to do it... resend them everything they asked for... my friend had to go and get another medical exam done because they said almost the same thing to you... im not trying to be a smart butt but really they are in total control right now and you just have to do what they say =(

Sorry Roshiloto - it looks like they lost your medical exam. That sucks :( It does happen from time to time.

The only thing to do is to get a new one done here in the US. Call around for quotes - it should cost around $200 or less. Good luck.

Hello, as suggested I would go and get the medical done again. I do have a few questions though if you don't mind answering them. Could you let me know when you submitted your AOS forms and how long it took to get this RFE? I only ask as I too came to the USA on a K1 Visa and I submitted my AOS in mid June. I have had my Biometrics but I did not submit the I-693 form. All I did was put in a notarised copy of the vaccination record I got from the Consulate. I have not received an RFE for this yet but I do expect so. Also the USCIS has not updated my status online from the initial Acceptance so I have no idea what is going on...As most people don't when it comes to the USCIS.

I called a Tier 2 Officer and basically I was told that I could send them a message stating that they have the documents, because it (the documents) was taken from me by the US Customs, but I can get a denial. What I can do, which will be probably smarter is go and show the certified doctor what I've done and fill the I-639 again. Coz you know, USCIS wants us to be punctual but then again they can do whatever they want. Would I get a refund for the money spent of the new exam? Probably not.

PS: Sent the documents in February.

For people wondering what happened - the POE packet with the complete medical result was not properly forwarded from CBP to USCIS. The OP did nothing wrong.

OP - I would get a new medical done. People have tried to fight it before, but this medical record needs to be in your A file. You could try to contact the POE you had but I doubt you'd get any action. I would fight this after compliance - I think this somewhat common procedural error from CBP is unfair and should be corrected. Alerting someone to it should be done. However, I don't think getting it corrected now while the RFE deadline looms is so wise, namely for your mental health. Good luck.

So basically go do the I-693 and then after submitting it I should start calling Tier 2 officers and complaining and request a refund?

There is no way to get a refund. You could contact senators or the USCIS ombudsman, or maybe CBP itself and make a formal complaint, so that in the future, a suitable fix to this problem can be found. It will not help you, but you might be able enact change for the future with your story.

Still don't understand how they can lose the medical stuff at POE, and not the whole package. Just by curiosity, at which POE have you entered, OP?

What makes you think the whole package isn't lost?

Because the USCIS always mentions only the medical docs, and never say that the whole package "was not forwarded", maybe? I don't know the truth behind that if you want to know.
