hello to all. i hope you can help me and can anybody give me a advice about my situation. i just got married last april 4,2012 thru double proxy marriage but i just read recently that proxy marriage is not legal here in my country Philippines. My husband decided this kind of marriage because we thought its very easy way to apply for k1 visa then re marry again in the states when i get there. but i just read that it should be both single, yeah of course im still single here in my country but my husband he has already a record that he got married of me thru proxy marriage. We contact the person who process the proxy marriage but he just advice us to meet first and save those supporting documents because he said that we can apply K3/Cr1 but since not legally accepted here in my country the proxy marriage.we are very confused and upset this matter and we dont know what step we will do after he will visit me here in Philippines.if what is the best visa we can apply or do we need to marry here in Philippines then proceed the cr1 visa after?please help us..i am looking for your help and advices.

k1 is a fiance visa not a spouse visa. you cannot apply for a fiance visa if you are married. read the guides at the top of the page . it would be in your best interest to do things the legal and correct way instead of trying to get around the system and having it come back to bite you in the #######

It could be that the marriage is not recognized legally. Montana is the only state in the USA that recognizes double proxy marriages. There exists the possibility that you can not file for CR1 as the marriage is not recognized by your country nor the US (unless he is from Montana). Which also means there is the possibility that you could apply for K1 as long as you meet all of the criteria. It may be that the best option for you guys is to clear up all confusion and have a real wedding in the Philippines and then file for CR1.

Hopefully someone can add to my response that has had experience with this double proxy marriage.

Right now it would be very difficult for you to apply for either the K1 fiance or the CR-1 spousal visa, as you are not both free to marry- so no K1, but also have not met in person and consumated the marriage- so no CR-1. I would think that if a double proxy is legal where it was done, then you are legally married, but you will need to meet first before filing for the CR-1.

Out of interest, why do the double proxy if you already were told you'd need to meet afterwards to file?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
