Hi everybody,

I have US passport but I don't have social security number, because I have not been in USA for 25 years.

Now we (me and my husband) are living in Spain and I want to fill in I-130 Petition for my husband and move there together.

Does it make any problem if I want to apply for him as IR-1? or it is compulsory to have a social security number before?

Please help me if you have any info or similar case. :help:

A social security number is not required. Though you will want to obtain one ASAP.

You will have to establish a US domicile. And also show that you've filed US tax returns (the US taxes on worldwide income, though there is a foreign tax exclusion) if needed.

A social security number is not required. Though you will want to obtain one ASAP.

You will have to establish a US domicile. And also show that you've filed US tax returns (the US taxes on worldwide income, though there is a foreign tax exclusion) if needed.

Today I just sent the I-130.

I have to go through it as soon as possible. Now I have two more questions:

1. Is it okay if I write my uncle address as US domicile? (actually he would be our co-sponsor too.)

2. Do you know How I can file a US TAX return while I am abroad?!

Actually now I am student and I don't have any income!

If both of you are living in Spain – can you not do the DCF?

DCF is not available in Spain, there is no USCIS field office located there.

Actually now I am student and I don't have any income!

You still need to complete tax returns. I wasn't in compliance myself and just sent in mine for the last 4 years (I am 10 years abroad). You use from 1040 (standard tax form) and 2555 (foriegn income exclusion). As long as you made less than $90000 in any given year you should only need those two forms.

You need to search the IRS website for more detailed info but that should give you enough to start your search.

If you've had no income at all in any country or too little to meet the income threshold for filing, you may simply hand write in the past income tax return section, "Income below threshold to file tax returns." and leave it at that. If you've had income above the threshold, you need to file the returns for any such years in the range 09 - 2011.
