Would same sex (USC) spouses be allowed to combine incomes for sponsorship?

I haven't heard the question raised. And I'm not sure why I thought of it.

I can't see why they wouldn't be able to combine incomes (I-864 & I-864A).

I wouldn't see why it would matter. It's like couples (hetero) who file separate or together and just one becomes sponsor or I just read where mom did a I864 and dad did one. it doesnt say couples have to be married or sex right.

Can they file taxes jointly, or list one as dependant on the other? If so yes, I would think they can combine incomes.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Interesting question. I never thought about that before. The IRS and USCIS follow DOMA, unless in the near future it is deemed unconstitutional by the Supreme Court, but for now they still do. I suppose they could say the same sex spouse does not qualify as a household member because they are not able to file federal taxes as married and are not considered spouses under federal law. I personally think they should be able to, but what we feel personally doesn't always equate to federal law.
