AOS-RFE (CR1) Did not file 2011 Tax Return

Hi Guys,

Need some advice here. I called NVC and they told me they need my 2011 tax return to proceed with the next process, but the thing is I have been living with my wife in the Philippines since 2011 up to now, I was informed that I can file it as soon as I get back to America (is this true?). I was employed also for 6months on 2011 and then became an Independent Contractor later on up to the present time so I can be with my wife that I love so much.

What kind of document do I need to show NVC about this? Has anybody been through this before?

Need your thoughts so I can get this done right away.

That is not true. As a USC you must file taxes no matter where you live. You need to file 2011 taxes to proceed with the visa case.

Did you file for an extension before you left?

Hi,

I did not also file for an extension. I am in the Philippines since Feb2011 until now.

What should I do? NVC is looking for the 2011 tax return but I am going to file it when I get back to Anerica at the end of the year of course together with my wife.

You need to file that now or ask for an extension. Either way you got to file it in order for the AOS to be approved.

No need to physically be in the US to file a tax return.

No need to physically be in the US to file a tax return.

This is a key point. It sounds as though a joint sponsor will be needed unless the petitioner's income will continue from the same source after returning to the USA.

Need to file the tax return before the NVC will proceed. An extension will not work at this point since it is already late. In fact, they now will require the tax transcripts before moving on. You can file your tax return from anywhere in the world.

From the AOS instructions:

If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support.
