AOS in US without visa...

Typically, no electronic devices are allowed. I think the main reason for that is that they do not want anyone to film or record anything :bonk:

You don't need thousands. It is more advantageous to have pictures that obviously show you together, but also, paint a timeline, photos with other people in them, photos of any vacations together or personal getaways, and photos of the wedding, reception, and family members.

o thats right too, dang. well, i guess ill take the pictures that are relevant to walmart and have them printed off...sigh o well, i suppose if this is the least of my worries lifes pretty good ;)

In regards to your statement about your best piece of evidence being your child, that is not necessarily true. It is easy to have a child together and NOT be in a bonafide relationship (marriage). But, it is a positive piece of the evidence you will be submitting. Just not the "smoking" gun.

Here are some other tips. BTW, the advice about getting a letter from your grandma is key. Health insurance coverage as a family is a plus. Bills together? If you are even saying that you have very little evidence to show you are legitimate, then you definitely need to work on changing that. Just remember, this isn't an emotional plea with them. Pretend you are in court and you have to prove with facts and data that you are legitimate. Compile the evidence and let it speak for itself. There are hundreds of thousands of people going through these interviews and they come up with the evidence. It may take some work on your part, but you will have to do the same thing. The argument that "your situation" is different than everybody else's will not suffice.

I think that is being a little hopeful. It appears it is a little more than that right now. Especially if your case gets transferred to CSC. They are running at about 6+months right now. With Obama's new initiative, it appears that some of that workload is "cutting" in line in front of AOS based on Family. I sure hope it is more like 4 months. That would be awesome..!!!

They won't be transferred to CSC. They are required to have an interview because they aren't adjusting from a family-based visa so they will be processed through their local office.

I'm talking specificallly about non-K-1 AoS, which takes longer as you say and can sometimes wind up being transferred to the CSC.

On the April filers group the majority of our people have actually been approved inside 90 days.

You can see the current processing times for local offices here: https://egov.uscis.g...sDisplayInit.do

Select the local office that holds jurisdiction over your residence (and if you aren't sure just plug your zip code into the tool at the bottom of this page and it will tell you) and see what their current I-485 processing times are.

Most offices are taking approximately 4 months to process I-485 applications.

It was pointed out to me by a senior member that they don't publicize the processing times for family-based AOS applications, and officially there are no time limits. If this statement is incorrect, could someone please point out differently. I have looked at the websites and they show Employment-based adjustment applications, Under the Haitian Refugee Immigrant Fairness Act (HRIFA), grant of asylum, and refugee admission, but not Family-Based.

as for having bills together...we have none. we live with her grandparents in their house. they pay all the bills. they own the house. she has a bank account and the bank will not allow me to have my name on it until i have my GC. we DID live alone and were paying rent when she was working last summer in an apartment, BUT she got pregnant and wasnt allowed to perform the regular duties her job called for. ( her doctor provided that note ) so, we obviously had no other source of income AKA employment, so we were forced to move in with her grandparents as of sept. 1st 2011. we have been here ever since with no bills, no job, no nothing except for the baby and us. AGAIN..all we have is that old lease agreement, the washer/dryer set we purchased in both our names, pictures, a daughter together and letters we will be able to produce...we dont have money for any life or medical insurance. infact, my wife and daughter have medical coverage under medicade but its government funded and my name certainly is not on any of it BECAUSE i did not have a alien registration number or visa UNTIL a few days ago... so , wether our situation is different from anyone elses or not, it is what it is. what else can i provide besides pictures, birth certificate for daughter, old lease agreement, and washer/dryer payments and letters?

the deal is, i crossed via land in a car with my folks. crossed without getting a visa as im canadian. came to visit the wife and decided to adjust status. what he is saying is, because i am here without visa and i am canadian, they will supposedly treat me as a person with a B-2 visa. makes no sense to me, but there you have it.

The CHILD is only proof that you had UNPROTECTED sex.

Gotta get creative. Here are some of the things I am using as proof. Some might be stupid, but every case is different and who knows. I'm not going to list stuff we have that you can't get at this time, ie paperwork.

- pictures

- notarized letters from family/friends do proof of relationship.

- greeting cards we have sent

- greeting cards we have received - birthday, Christmas cards, thank you notes. (keep the post dated envelope)

- Facebook chats, facebook postings (either between the 2 of us or some are between me and other people talking about my husband)

- Emails (again, either between my husband and I or emails with others discussing our relationship)

- texts (I took screenshots of our convos on my phone, emailed them to myself, put like 9 to a page in word and printed many pages)

- receipt for pool passes. Photo copies of our pool passes.

- receipt for nice hotel room on our anniversary with pictures to go with

- copy of paperwork for "memberships" (movie theater, cvs drug stores, pet stores gas stations. These are free and the paperwork has both names.)

- any mail we have received with both our names on it. (obviously keep the envelopes).

I'll be continuing to think of things and adding to my collection until the day of my interview. Definitely have to think outside the box with this one.

No you don't have a visa, since you overstayed your B-2 visa you were out of status.

Now you have your AOS and just waiting on the interview. The thing is, there is actually a kind of amnesty for people in your situation during the interview when it comes to situations like this. I still never understood why they still have this, but regardless if you were here illegal, once you got the AOS they won't make a big deal over it. This is the same as your INFOPASS appointments. They seriously need to change this, but as of now (if it is the same as the past), you won't have issues during the interview. Just be honest with them and you should be fine.

Strange I know, and still never understood why they have the amnesty towards this when they shouldn't be. I guess for the interviewer, they figure if you qualified and received the AOS then, that's good with them. No clue, but it's the way it's been for a long time. So you should be perfectly fine.

I just hate bringing this up on these boards, because I don't want others to feel that the only thing they have to do to immigrate to the US is just come over illegally or get a B-2 and over stay it and then get married and boom they're safe. Kind of downshadows all of the millions that actually went through the proper paper work and stuff to get married.

But in your case it did seem that you didn't intentionally come over with the though of getting married when you got your B-2. I may be wrong, but either way, it's still kind of insulting to many for those that do lie to the INS to get a B-2 with the full purpose of just getting married without going through the proper channels that many worked so hard to get. This is why I'm hoping they stop the amnesty process soon...

The point is just that you are adjusting from a non-family based visa (ie you didn't come here on a family visa). So your process will follow that of someone who came on a B-2 because you also came as a visitor, though not on a B-2. As such, you will definitely have an interview and be processed at your local office.

I suggest you look through timelines on VJ from other people being processed at your local office to see how long they are actually waiting.

Timeline

No you don't have a visa, since you overstayed your B-2 visa you were out of status.

Now you have your AOS and just waiting on the interview. The thing is, there is actually a kind of amnesty for people in your situation during the interview when it comes to situations like this. I still never understood why they still have this, but regardless if you were here illegal, once you got the AOS they won't make a big deal over it. This is the same as your INFOPASS appointments. They seriously need to change this, but as of now (if it is the same as the past), you won't have issues during the interview. Just be honest with them and you should be fine.

Strange I know, and still never understood why they have the amnesty towards this when they shouldn't be. I guess for the interviewer, they figure if you qualified and received the AOS then, that's good with them. No clue, but it's the way it's been for a long time. So you should be perfectly fine.

I just hate bringing this up on these boards, because I don't want others to feel that the only thing they have to do to immigrate to the US is just come over illegally or get a B-2 and over stay it and then get married and boom they're safe. Kind of downshadows all of the millions that actually went through the proper paper work and stuff to get married.

But in your case it did seem that you didn't intentionally come over with the though of getting married when you got your B-2. I may be wrong, but either way, it's still kind of insulting to many for those that do lie to the INS to get a B-2 with the full purpose of just getting married without going through the proper channels that many worked so hard to get. This is why I'm hoping they stop the amnesty process soon...

i really had no idea, i am very sorry to all as i truly meant no harm. like anyone, i simply had/have questions. our case is really different than most and my intentions were and still are very pure. its not like some one educates you on the immigration laws, forms, and steps that there are to becoming an LPR and citizen. like most im assuming, i just researched everything on my own and filed my papers etc. i truly appolagize if i have offended anyone by my posts. i know its been alot tougher for others and i thankfully have been put in a very fortunate situation. again, i still have my fears and paranoia like everyone lol.

Day 013- 08/22/2011 - Received receipt for I-130

Day 198- 03/07/2012 - Text and email confirmation of APPROVED I-130!

Day 203- 03/12/2012 - I-130 approval letter received

Day 323- 07/05/2012 - AOS package (I-485 + I-765) mailed to Chicago Illinois

Day 329- 07/11/2012 - Text and email confirmation from USCIS of receipt

Day 332- 07/14/2012 - Received receipts for I-485 and I-765

Day 336- 07/18/2012 - Recieved ASC Appointment Notice (biometrics) for 08/02/2012 @ 8:00am

Day 341- 07/23/2012 - Biometrics early walk-in SUCCESS!

Day 372- 08/23/2012 - Text and email confirmation of Interview date set for October 4th, 2012

Day 372- 08/23/2012 - Received interview letter in mail!

Day 384- 09/04/2012 - Text and email confirmation of EAD Card Production. OMG! approval feels good!

Day 390- 09/10/2012 - Text and email confirmation of EAD Card mailed to address on file

Day 390- 09/10/2012 - Text and email confirmation of USPS picking up mail from USCIS

Day 393- 09/13/2012 - Received EAD Card in mail!!!!

Day 393- 09/13/2012 - Text and email confirmation of USPS reporting the EAD Card was received by customer!

Day 414- 10/04/2012 - Interview and on the spot APPROVAL! PERMANENT RESIDENT!
