question about Affidavit of support - no paystubs

Hi everybody.. since my income didnt reach the poverty guidelines of 5 family household..since I didnt work fulltime due to staying for so long in the Philippines.. so Im going to get my mom as a secondary joint sponsor ( shes an RN) and she earned $150k last year which is good enough for 5 family household (me,my mom,2kids and for the beneficiary my husband) BUT... if time comes theyll ask for affidavit of supp.. she cannot provide recent paystubs for this year because she decided to work as a PDN(private duty nurse)because the pay is higher but theres no w-2/1099.. she receives her salary now through direct deposit in her bank from the patients funds..

so my question is.. if we submit the 864 affidavit of supp. form together w/ her last year tax income..do we really need to submit also a recent paystubs or the 2011 tax income of 150K is enough..im afraid they might ask.. and if its really needed. do I have to look for another joint sponsor that has recent paytubs? thank you! hoping someone will help me with this prob of mine. :)

THANKS for replying.. she did not fill up schedule C or any of the forms I think.. because she was not self employed last year.. she was still working in the hospital with paystubs/w-2/1099.. just this year she decided to work as a PDN so she dont have paystubs for this year :( what to do? i think thats the major proof that I need to show to them that she can provide support because she is earning monthly/weekly as seen in the paystubs :(

Pay stubs are OPTIONAL in the AOS package. You're fine!

omg are you sure? because I was thinking that is the major proof that the sponsor is still earning in the present and can support the beneficiary that can be seen in her recent paystubs.. well if thats what you say sooo.. whew! thats a relief! :D:thumbs: i pray now that after sending it w/o paystubs. they wont ask for RFE (paystubs) :blush:

She will need proof of income for this current year' a transcript from the IRS for only:, 2011 will not show current ability to support. If she does not receive current pay stubs due to beng PDN, try getting a letter from her employer, stating date, hours, rate of pay, and copy of her direct deposits from associated employer.

Don't assume that all embassies and consulates act the same. Manila can be one of the pickier places.

The OP is asking how to verify current and continuing income. Can't just take a sponsor's word for it.

Some sort of proof of income claim is going to be needed. $150K was last year. What is needed is assurance of what is being earned presently.

Statements from clients and bank statements showing corresponding deposits sound like the only thing available to support the income claim.

Pay stubs are OPTIONAL in the AOS package. You're fine!

sigghh.. :cry: i knoww ..thats what I was talkin about.. they will really look for present paystubs and letter from the employer.. if incase the employer will not provide her letter.. can I just send her last years income tax and get another joint sponsor (my aunt, a nurse too) which can provide recent paystubs because shes working in the hospital.. sorry for too many questions and I appreciate much all your help! ^_^

Ask your AUNT , (if she is willing to do so) to be a JOINT SPONSOR which seems to be the best course of action on my view.

A joint sponsor can be any U.S. citizen, U.S. national, or lawful permanent resident who is at least 18 years old, domiciled in the United States, or its territories or possessions, and willing to be held jointly liable with the petitioner for the support of the intending immigrant. A joint sponsor does not have to be related to the petitioning sponsor or the intending immigrant

Hope she also makes same FAT pay check... :blush::blush::blush: ..lol...

yeah i think thats what I really have to do.. since my mom is not sure if her employer can give her letter .. and yes my aunt has a goodpaycheck since shes an OR nurse ..now Im praying that my husband will not be denied in the interview even with my moms and aunt AOS..since im unemployed now due to nobody will take care of our baby here with me. ahh soo much stress to think off.. anyway.. thanks again. goodnight! :)

I am positive your Aunt meets the minimum income requirement to be a JOINT SPONSOR. If so, Your Aunt is more than ENOUGH...you dont have to show any thing about your moms income...On such a situation, I am 100% ( or make it 99.999999%) sure, your petition will not be denied due to AOS.....throw your stress out of Window and have good night sleep..... :dance::dance: :dance:

thanks for the reply.. if only I can do that so theres no too much of a hassle. only 1 joint sponsor.. but.. im still living with my mom. so I still need to send hers(I-864A) :thumbs: and they might question me how do I support my self and kids w/ no income if I dont put my mom on the same household - shes the one supporting us right now until I can get my husband which is a nurse too..so I really need him badly so we can move out from moms house hehe :)

She should be ok, because they only ask for the last tax transcript, however, as someone pointed out some consulates may be more demanding. In this case, have her send you her last bank statements, if she can't produce pay stubs.

Just going to second these responses. This appears to be a currently self-employed sponsor. Self employment income is not "income" in this context, until it is reported on an income tax return. If an "employed" sponsor is available, that would be a better choice.

To Saylin.... All sponsors need to show evidence of current income. For the "employed" a current pay stub and/or an employer letter, is how this is generally done. Those with histories of good employment income often get by without providing this evidence but I would never advise anybody that providing it is "optional". Which option you choose is a choice but choose one.

Specifically, in this case, the sponsor's past tax returns are going to show them as employed by XYZ hospital but their affidavit will show them as self employed. It is possible that Manila will consider the "current" self employment income to be zero BECAUSE it has not yet appeared on a tax return. Business "revenue" is not the same as business "income". Income is the profit left over at the end of the year after subtracting the expenses from the total revenue. You could have a million or more in revenue and still have no "income".

Facts are cheap...knowing how to use them is precious...
