I married my wife two years ago and since those two years we've been separated she claims that she change and wants to work things out but i don't believe her. My wife is a immigrant from Jamaica, we started as best friends but then became something more. In the end i was a nitwit for being blinded by love and i realize that, so i refuse to process her papers for a green card. My question is that it has been two years since our marriage and now she wants to make up with me after i was geared up for a divorce. I feel as if i do decide to continue with her process will i have to do the conditional green card process since we never did it in the first place. Or do she automatically gets her permanent green card without any interviews or immigration hassles. I mean how does that work for immigrants who been married for 2yrs or more and never have done the conditions in the first place, will it lead for her getting her citizenship too in her 3rd year as we reconcile. If It does work like that, i think a loophole hasn't been discovered. She says she wants a lawyer to do the process im ok with that but it will be a long time before i sign anything for her until i can really trust her again. Also isnt better that she finds someone else to marry since we never record our interviews and papers with USCIS. Last time i check we were just only married and never lived together. Plus, im a Floridian and im not a mean person but i am skeptical and confuse with immigration cases.

If you were to reconcile with your wife, you would still have interviews and have to show a lot of evidence/hassles to get approval. If approved, she would be eligible for citizenship in 3 years from approval, not one year from now (not 3 years of marriage only.. 3 years of marriage and 3 years of being a PR).

Tread carefully and work on your relationship first. If you think she is scamming you, she probably is.

You have not discovered a loophole.

I also wanted to know the advantages and disadvantages im in. I have it in my mind to divorce her and report her to ice since she thinks it all right to play with peoples emotion but im to soft to do that. I try to beat the statics of 50 percent of marriage end in divorce but i cant believe she turnout to be a cold heart ice queen. When we argue im always on the defensive when i know im right. Till now she still haven't change.

If she came on a K1 or the CR1? If a K1, have you done the AOS yet?

You have really answered your own question, she wants you to finish the immigration process, it doesn't sound as if she is asking for a re-conciliations of the marriage. If you wish to do something that is not morally and ethical within your belief, we on VJ cannot answer that. Only you can decide if you wish to commit immigration fraud.

Also, that 864 finical statement is no joke. You will be responsibile for your wife for the next 10 years. Let that sink in.

Why are you asking me about love, I don't know you or her. If it's love then do what love dictates you to do. My comments are only based on what you have posted.

If it's love then seek marital counseling.

I guess my next question is will you call ice on a person that duped you into marriage.

This question has nothing to do with doing the right thing. If you are asking me would I call ICE if someone duped me into marriage. Nope, I am grown, I understood all that I was getting into before I entered into the immigration maized. But I wouldn't sign my name to a 864 if I had doubt in my mine this this relationship was real.
