You mean battered, not assaulted. Battery is the unlawful touching of another person. Assault is threatening bodily harm with the means to carry out the act.

Also, self-defense is an affirmative defense (the defendant has no presumption of innocence, the presumption is that of an unlawful homicide, and the defendant must meet the standard of acting as a reasonable person in defending himself), and in Florida, the stand-your-ground law may actually work against Zimmerman in this case. The judge alone will decide whether Zimmerman is granted immunity before a jury hears the case. The jury will not be instructed to consider whether or not the homicide was justified.

I would be interested as to what this judge's record is with self-defense immunity hearings. I know the prosecutor has been extremely successful getting convictions in other alleged self-defense cases.

imo the judge will rule in zimmerman's favor. a single shot was fired. if 3-4 shots were fired, he'd be screwed. 1 shot.

George Zimmerman's Sanford, Fla., neighbor, said the neighborhood watchman protected his residence from a potential burglary several weeks before the shooting of Trayvon Martin.

Frank Taaffe, a former neighborhood watch captain, told CNN's "Starting Point" that his house was in the process of being robbed on Feb. 2, but Zimmerman called Sanford police, who thwarted the robbery.

"My house was being robbed, and George on his nightly rounds watched this burglary in progress, called Sanford P.D., waited for them, and helped ensure that nothing bad happened to my house," Taaffe said. "And it's documented in the 911 call for February 2. That was my residence that George Zimmerman helped stop." Zimmerman shot and killed Martin on Feb. 26.

"Neighbor-hood, that's a great word," Taaffe said.

Taaffe said that "young black males" were the perpetrators in the attempted robbery of his home. "We had eight burglaries in our neighborhood all perpetrated by young black males in the 15 months prior to Trayvon being shot," Taaffe said. "It would have been nine."

Taaffe denied that he told the New York Times that burglaries were done by "Trayvon-like dudes with their pants down."

"I never said that," he said. "I never used that term."

But on CNN, Taaffe followed up the denial of an incendiary comment with another one.

When asked if, based on the string of robberies, Zimmerman should have been profiling Trayvon Martin the night of the shooting, Taaffe said: "There's an old saying, 'If you plant corn, you get corn,'"

"It is what it is," he added. "I would go on record by stating that of the eight prior burglaries in the 15 months prior to the Trayvon Martin shooting, all of the perpetrators were young black males."

In an affirmative defense, the defendant affirms that the condition is occurring or has occurred but offers a defense that bars, or prevents, the plaintiff's claim. An affirmative defense is known, alternatively, as a justification, or an excuse, defense.[2] Consequently, affirmative defenses limit or excuse a defendant's criminal culpability or civil liability.[citation needed]

A clear illustration of an affirmative defense is self defense.[3] In its simplest form, a criminal defendant may be exonerated if he can demonstrate that he had an honest and reasonable belief that another's use of force was unlawful and that the defendant's conduct was necessary to protect himself.[4]

And so who will testify against him? While we thought that Trayvon would not be able to, what was announced today, the bruises on his hands consistent with punching somone will actually be his mute testimony. Looks like Trayvon will get to say something after all.

I do not see a prayer of getting a conviction in this case but we will wait for the trial, if it occurs.

Even a judges ruling that he cannot be shielded from prosecution does not mean he cannoit use self defense as a reason and get acquitted. The judges decision can PREVENT a trial but it cannot prevent an acquittal.

The few true facts known so far is that it was night time, Zimmerman saw an unidentifiable person, someone got b!tch slapped numerous times, a gun was fired and someone died. Considering that this is such a sensational and highly televised case occuring in the state of Florida, Zimmerman will be found not guilty, go into hiding then pop up a few moths later on you tube.

I'll surmise Mr. Martin never received that training, and instead, used his fists. A closed fist isn't a 'b|tch slap'.

I think you deliberately dodge the point, Zimmerman initiated the contact against the good advice of the 911 operator. Zimmerman got himself punched in the face by using poor judgment and ended the confrontation his poor decision making, to say nothing of his apparent lack of non-lethal defense skills, and ultimately shot Martin.

No self defense in that, or you can walk around armed, abusively confronting others, then shoot them because you're scared?

How did Zimmerman initiate contact? He followed the kid. Lost the kid and then the kid confronted him... Sounds like Trayvon initiated the contact...
