second rfe

Hi. i just got an e-mail that the uscis sent me a second rfe. I contacted the immigration services when i got my first one and sent everything the officer told me i needed. The only thing i can think of is did i need to send the tax transcript for the past 3years or was a copy of tax returns enough?thanks

Along with the tax returns did you send the W2's/1099's and other supporting documents? If not, that's the likely RFE.

I sent my husband's w2 and his dad is a joint sponsor but he is self employed and doesn't have w2. so he wrote a letter explaining that and it was notarized.....

Hmmm.. if self employed, does he have 1099's? that would be it... if not maybe they are looking for another joint sponsor if they thought they wont accept your husband's dad.

The best thing is to wait for the rfe, pls keep us posted. thanks.

Huh! Are you still on I-129F petition? W2's and sponsors are not needed yet... only during the interview... Why would USCIS ask that during the I-129F process?

The OP posted in adjustment of status and they also have a current timeline showing filing adjustment of status. They are adjusting their status not filing an I-129F.

Well it's past the tax deadline. The best thing is to request the transcripts. Whatever they request, do your best to send it so you do not get a denial for failure to submit requested evidence.

Yes... although they said they prefer transcripts but copies are acceptable. My Hubby used it to bring his parents and everything went well with copies.

USCIS usually won't RFE you twice for the same thing. You either get it right or get denied so I would guess it is probably for something else.

The complete tax return, not just the form 1040. If the sponsor is self employed then there are many additional forms that make up the complete tax return.

Well, there is little use guessing at what the RFE may be for. BUT, did you submit proof that his father is a US citizen or permanent resident? That is required for the co-sponsor, they already have it for your husband.

2nd RFEs are unusual. They will usually NOT be for something they have arleady sent you an RFE for. If it were, they would just deny your case. They have discovered something else they need information on, probably not related to the first RFE. It is not usual because they try to do it all at once, but it can happen.
