I applied for my wife after our July 2010 wedding to stay in the US. Because we were not sure how to proceed and to make sure everything would go well, we used an immigration lawyer (referred to us by a friend). Now is time to think about the lifting of restrictions, so we contacted the lawyer and he is asking us another very important sum of money to take care of this, which we cannot afford at this point (as financial situation had worsen since our marriage). We are thinking about proceeding for that step by ourselves: requesting 2 affidavits and all the documents (we had a child since then) and application for lifting of restrictions. Does anyone forsee any negative to proceed that way? will we be red flagged because we are not continuing the process with the original lawyer? thank you so much for all/any comments you may have about this..

You can do it yourself. They will think you finally figured out you never did need a lawyer.

I don't see a reason why there would be a problem with not using a lawyer/and or the one you orginally used. Most people do this journey without the use of any attorney at all. And there is really not reason for one at this point in the process. Good luck :)

It is so easy to do ROC by yourself. Why do you need a lawyer anyway?

Just filling a couple of papers, they charge like $3,000. Are you out of your mind?

I do these kind of paperworks (immigration or non-immigration) every single day for my friends & they just give me a bottle of scotch :)

We used a lawyer for AOS, but not for ROC (granted, we haven't been approved yet, but I don't see why we wouldn't be). Our lawyer called us at the beginning of February as a courtesy reminder and she was totally supportive of us proceeding without her. I would think that she would have told us we needed to stick with her if it would have been detrimental to our case to go it alone (or if she was unethical, which she's not, but it's safe to assume many people are). Good luck!

AOS (from tourist w/overstay)

1/26/10 - NOA

5/04/10 - interview appt - approved

ROC

you technically do not need a lawyer, unless you have a complicated case, arrests or such. we didn't use a lawyer for removal....just follow the instructions and guide on this forum and you will be fine. Ask questions if you are not sure of anything as well. Whenever you have everything ready to be sent, put out another post with all supporting documents enclosed and people on here would give their comments and recommend anything else. good luck!
