I have my interview on may 17th but my usc husband won't be able to attend as his police academy starts in just over a week. Will that be a problem? If not, can i bring our 8 month old son with me?

Yes its a HUGE problem the USC needs to be there for the AOS interview. The only time I have seen the USC able to not be there is for active duty military personnel deployed overseas.

He HAS to be there. The interview is based on your marriage. A absent spouse is not a good sign unless he is deployed overseas as stated in the previous response.

You can bring your son.

Generally the spouse MUST be there unless they are deployed but I'm not sure if police academy is a reason they would accept as well (unlikely). If he absolutely cannot get the day off I would make an Infopass appointment and ask what to do.

Your eligibility is based on your marriage and him not showing is a major problem. Read your interview appointment letter. It specifically says you have to attend with the USC. As I said in your other post, you know what day it is, so you can make arrangements for him to be available or reschedule your appointment. Be aware that rescheduling your interview will incur further delays for all your pending immigration benefits.

As others have said your husband HAS to attend. He is not in the military which would be the only situation in which he wouldn't have to attend. You can bring your child with you as well.

I suggest you reschedule the appointment. I would try sending a copy of his police academy paperwork so they know when he'll be gone and asking for it to be after he gets back, or before he leaves. OR you get him to find out if he can take a day off police academy training to deal with your immigration situation.

Thanks for all your responses and help, I just received my letter today so monday morning he will call his police department and find out if he can get at least a couple of hours off (scheduled for 8am) or we'll have to reschedule the appointment with USCIS.
