I didn't know that. I actually was requested to email a scan of my EADl, my AOS receipt, and my visa on my passport. I thought "weird, but they must be really interested in hiring me" so I went ahead and did it. I was hesitant on email it. But it was actually for a law firm so i figure it;s ok. but now that I know this how can they ask me of this? I mean if I don't give them what they want I risk the chance of getting hired. They ended up not hiring me anyway. They had mentioned they had a problem one time with this guy from australia, he got hired, then two months later he told them they had to help him stay in the country. I had explained to them that I was on a Fiance visa and I don't need sponsorship I already have it and my AOS is in progress. I can work legally and have a SSN. They requested all that info from me even after I showed them my EAD at the interview and they still requested scans of my info. They even called me for a second interview after i sent them my info via email. then canceled the interview and I had to call them today and find out the position had been filled. This all happened over a weekend. it's so disappointing.

they have absolutely no business asking you for any documentation prior to making you an offer and the only question they are allowed to ask is "do you need sponsorship?" (Unless of course the job explicitly says requires US citizen which only sensitive government jobs do.)

I would send them a letter saying that you are considering complaining to the DoL for discrimination unless you get a formal apology and damages.

Today I received a reply from my congressman's aide telling me he received a response from VSC this morning.

They essentially doubled-down and told him that my I-360 was in their normal processing queue, that they were currently processing I-360s from June 2011 and that my I-485 would be reviewed after my I-360 was finally adjudicated. Essentially I am looking at the middle of next year - at the earliest - to receive a decision.

I contacted Brent Renison, the pro bono attorney for Surviving Spouses Against Deportation, whom I had spoken with before, and he confirmed that he has filed "numerous" concurrent I-360 / I-485 applications for widow/ers and none of them were transferred to VSC, they simply filed at the Chicago Lockbox, interviewed at the local office and were approved in the normal fashion. Why USCIS has decided to play these games with me I have no idea.

Anyway, he suggested and I agreed that contacting the DHS Ombudsman is now my best chance to get this resolved. I have told my own lawyer that this is the option I wish to pursue, and provided she does not object then I will file a request for the Ombudsman to investigate.

At this point I'm not even angry or mad, I'm simply curious as to why this is happening.

Anyway, the Ombudsman is my last shot at getting this resolved anytime soon; if that doesn't work out then I have no recourse other than to wait on their timeline.

As promised - our interview experience:

Had our appointment at 1:45pm - Made it just in time... No Traffic!

Handed our interview appointment letter, and waited for our names to be called.

We were called in after about 30 minutes, more or less - walked into a nice office

and were sworn in by the interviewer, who was a very nice, warm lady.

She proceeded to confirm just the basic stuff - address, phone numbers and date of arrival in the country.

Other than that, all we did was talk about travel and other unrelated subjects.

She approved us on the spot, took my I-94 and voided my US visa. I was handed a letter congratulating me on my new status, and informing me that my GC will be mailed to me within 90 days.

Overall, the entire interview took less than 20 minutes.

The following day I got text messages notifying me that my status has been changed and that I am now a legal resident.
