SENATOR RECEIVED INFORMATION FROM EMBASSY

I just returned from Turkey and received a message from my Senator's office. She said that she called the American Embassy in Turkey and they told her that Umit's interview was on January 12, 2012 and that they are requesting more documentation of proof of a bonafide marriage.

Umit had a folder full of proof with credit card statements, phone bills, chat logs, hundreds of photos, webcam documentation and photos of webcam conversations, but the Embassy officer would not look at any of it.

I am now hoping that we do get a Notice of Intent to Revoke because if USCIS just reaffirms the petition and sends it back, the Embassy officer will still not be convinced this is a bonafide marriage.

Has anyone else gotten this same reason for returning the petition when your husband had folders full of proof that the Embassy officer refused to look at?

Welcome back Dear, I don't think they will be able to denied the second time after you send more proof , but with them you never know. If they do, then you fight again. We can't give up

Yes it is. And we also received the 5 page RFE letter and sent more proof then. I just do not understand what else to give them. We submitted a joint bank account and joint credit card. I own my own home so we can not submit a rental agreement. I lived with him in Turkey for a short while. I have been to Turkey three times and we went to the Dominican Republic once together. I am at a loss here.

They asked for proof of a bona fide marriage and the items you mentioned would not do that.

More correctly they are seeking evidence that the marriage is not solely for immigration benefit.

you can ask some of his friends/family to write an affidavit about your relationship with umit. Moreover, your passport with the turkish visa stamp. Did you mention you lived with him 1 year. Why don't you summit your visa application when you stayed in Turkey? Since you applied for a resident visa due to your husband is a turkish citizen(husband).

D- Residence Permits

An entry visa enables the bearer to stay in Turkey for the duration stated on the visa sticker. However, if the person intends or is obliged to stay in Turkey longer than the permitted duration, this extension is subject to the approval of the Ministry of Interior. In this case, the person has to obtain a residence permit.

"Applications for residence permits should be made to the Alien’s Branch of Local Police Departments (Emniyet Mudurlugu Yabancilar Subesi) within 30 days upon arrival at Turkey. Applicants are generally required to submit work permit, work visa, education visa or research visa and a letter describing his/her circumstances (i.e. employment, education, marriage to a Turkish citizen).

Once the person is granted with the residence permit, he/she can enter into Turkey multiple times as long as his/her residence permit is valid and thus he/she does not need a visa for entry into Turkey. If the extension of the residence permit is required, the extension or renewal should be made timely before the expiry date. The person is recommended to have the validity of the residence permit extended before leaving Turkey, if the validity of residence permit is to expire or has already expired."

Happens all the time in Ecuador, sigh man.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thanks Evelyn: Yes I already gave them copies of my resident card from Turkey and all my pages of my passport. We also gaving them affidavits from my friends and one from the only Turkish friend who could get us a notarized affidavit. When they send us a letter of intention to REVOKE, I will send them new phone logs, chat logs, webcam logs, airplane boarding passes from the latest Turkey trip and more photos where I stayed with him and his family. Umit is like your husband now, he is saying if we do not hear something on the visa by July, I should just move to Turkey or we could go to another English speaking country. So sad to give up my life here, but I will.

We were in similar situation. Embassy asked for more documents to prove bonafide relationship. We submitted the documents and after few weeks embassy sent us letter saying that case was being sent back to USCIC with recommendation for revocation, but they never sent the case back. After waiting for 2/3 months I went to Saudi Arabia and requested the Emabssy to give us another interview. The CO interviewed us separately and asked us the same questions. He then matched the answer and approved the visa.

My husband will be joining me here in the U.S beginning of next month Inshallah.

I suggest you go for his interview. Take with you some NOTARIZED sworn of affidavits from people who can state your relationship is genuine, and get some affidavits from his family as well, when your families know about your relationship, it makes it look genuine.

If he is a member from some church or mosque he can ask an affidavit from his priest/imam stating his is a person of good moral character. IF your husband owns a house in his home Country or have a business then ask him to make a WILL, and he should name you as a primary beneficiary, if he has something substantial in his name the WILL can help to prove a bonafide marriage, because a scammer won't never WILL name you as a beneficiary, and you will be able to prove to the US Consulate that your marriage is a bonafide marriage.

If you will be there for his interview make sure he knows basics things about you and you about him, because sometimes peoples do not pay attention to little details like what company do you work, for how long, how many hours do you work every day, what College did you attended, what does he plan to do once get you in the US? what's the name of your parents/siblings,what's the name of your best friend, your religion, do you go to church? how often? what are your hobbies? and you should know everything about him as well.

Take care

Sandra
