My RFE - Wants more evidence

michellek,

I think the same as you - a lot depends on the person who processes the petition. And how the evidence that is presented strikes them.

For the most basic items of evidence - e.g. boarding passes, entry and exit stamps in a passport - the 2nd variable is minimized. A boarding pass is a boarding pass, one's the same as another - date and points of departure and arrival. Start getting into other types of evidence and more information is introduced, more things for the officer to reflect on.

Another thought comes to mind about what could generate an RFE for additional proof of having met - the description of the circumstances of meeting. An elaborate description could give a case officer all sorts of ideas about things to have confirmed.

I bet high fraud visa countries have a higher RFE rate if we checked...

I sent the bare minimum & got approved.

What do you mean 'they don't like them as much'?

I don't think that is the opinion of the COs in Mexico.

i disagree. i am from a "high" fraud country but i only sent a few proofs of having met in the last 2 years; copy of passport showing entry & exit, boarding passes (only of the latest travel since i didn't keep the ones from an earlier travel...), receipt/proof of airline tix, hotel bills & receipts, receipts showing i made purchases while i was in the philippines and 5 pictures.

just to be sure i include about a few emails, snail mails and phone log showing the range of dates that i mentioned in my petition for proof of relationship. the entire petition packet was less than 30 pages total, including the 129F (3 pages) & two 325A (8 pages).

it depends on how you present your entire application packet...and the person looking at your application. sometimes you don't need a lot to prove a case. what's more important is the relevance of the evidence...not the quantity.

Fate is building a bridge of chance for the one you love...

Bill, you sent in WAY TOO MUCH info and that caused your AO (Adjudicating Officer) to request more info to verify all the info you sent. I'm not joking. Do NOT send anything more than what is explicitly asked of you. Whatever the instructions on the I-129F asks of you, send that only. If it's not enough, you'll get a RFE. Otherwise it's enough.

I sent:

copies of airline tickets and boarding passes

copy of my passport with ALL pages

6 photos of us together

I sent my package to CSC and was recently approved in 55 days.

Less IS more; I'm fully convinced of that.

Sending in all the other superfluous data just bogs down the process. What exactly does sending in hotel receipts or engagement ring receipts prove? You can NOT directly tie a hotel stay with a visit to see a SO. It could easily have been a business trip for your company. A ring receipt could easily have been a ring purchase for your mother or anyone else for that matter. ATM withdrawal receipts can't be connected to your SO. It could easily be a cash withdraw for business reasons on your business trip. All of these is useless and superfluous. All that matter to prove that you've visited your SO's country is the passport entry/exit stamps and the airline boarding passes. They show that you've visited during the past 24 months. Add along some photos of the two of you together and you have all the proof you need. All other receipts are superfluous and can't be directly connected to your SO anyway. It may only lead to MORE RFEs requesting to verify all the superfluous information you sent originally.

Tom sent a priority mail BOX of evidence of meeting in person and got approval in less than 30 days, here is what I sent:

copies of my airline tickets, receipts and itenerarry

copies of my hotel receipts

copies of my luggage tags

copies of my boarding passes

copies of my receipt for the engagement ring

copies of my passport with Thailand stamps

4 photos of us together

All this was sent for 2 trips I made to Thailand in April and July of 2006

The RFE specifically requests copies of bank statements or credit card statements showing withdrawals and purchases made in Thailand that include my name, location and full date.

I don't care what anyone says MORE EVIDENCE IS BETTER, THE MORE THE BETTER!

Maybe some of you have been approved with less than what I sent, and maybe it depends on who the person who is assigned to your case, maybe other factors play a role, but I am convinced beyond doubt that to send 'too much' is way better than not to send enough!

I will be posting this to the RFE thread also.

They also want more details on how we actually met.

Bill

PS I AM THRILLD THAT THIS IS ALL THEY NEED :D (unless I get another RFE  )

Depends on how proactive you are about getting your names together in clever ways. I've got pages and pages of hotel bills with both my name and my fiancee's name listed as guests. I have intra-Philippines ticket stubs showing us sitting in adjacent seats on the same flight. Pages of call logs from three different countries to her mobile. It piles up quickly.

We sent the new I-129F form the day it came out which included the IMBRA information. (June 19) However we received and IMBRA RFE later on after I had already given them the exact same info previously. #######?? Very irritating...It's not like it's changed. I still marked NO, based on Exception 2 of the IMB definition. But I was very nice and wrote them a quick description with info of the website we met at anyway and that I said no as it fell under exception 2. I just hope that when they finally receive our RFE this week they will finish our packet and grant us an NOA2! and hopefully they don't put up a fuss for saying No, and mailing it from England instead of back home in the USA.

Heck I buried them...I even included on going items... Like Western Union receipts, Sent Flowers Receipts.. 4-5 pic's of both visits With have the camera date stamp, Boarding passes...Passport stamps..

And I see they are trying to delay as many as possible with items not asked for in their own instructions on thier web site... Like Beneficary Birth Cert.

I honestly think these monkeys are told to find something wrong with as many as possible so they can delay them and get caught up...

And the way I'm reading it here on how some people send less and get approved..I'd say they are closing thier eyes... and picking which files are processed without a RFE and which one is Flagged for one.. probably a 4-1 ratio of flagged and not flagged..

Ultimately, it's a judgement call. First, the petitioner's judgement. Then the adjudicator's. There's always a human element that cannot be predicted, so while learning from each other on this forum is helpful, you have to make the decisions that are best for your individual situation. If that results in an RFE during the petitioning phase, so be it.

My totally proof-by-proctological-extraction guess would be that a name hit or a name change needed to be verified, and that's what the BC request is for, because if they could approve you without it, there's no reason for it to sit around waiting for an RFE.
