Help with Request for Initial Evidence (I-485)

Hello. Today I received a request for initial evidence (I-485). And here's what is says:

1. Submit a complete Federal Income Tax Return submitted to the Internal Revenue Service (IRS) from the petitioner/sponsor on Form I-864, for the most recent tax year

2. The joint sponsor on Form I-864, must submit a complete Federal Income Tax Return submitted to the Internal Revenue Service (IRC) for the most recent tax year.

3. The joint sponsor on Form I-864, must submit all supporting tax documentation (W-2s, 1099s and all supporting tax schedules)submitted to the Internal Revenue Service for the most recent tax year.

I sent them:

1. Copy of Form W-2 Wage and Tax Statement for 2009 tax year (only joint sponsor)

2. Copy of Form W-2 Wage and Tax Statement for 2010 tax year (lawful wife)

3. Copy of Form W-2 Wage and Tax Statement for 2010 tax year (only joint sponsor)

4. Copy of Form W-2 Wage and Tax Statement for 2011 tax year (only joint sponsor)

5. Copy of Federal Tax Return for 2011 tax year (only joint sponsor)

6. Copy of IRS Tax Form 1098-T for 2011 tax year (lawful wife)

I'm confused. I sent them everything they wanted. Is there a difference between the tax statement and the tax return submitted to the (IRS). How should I obtain the Federal Income tax return submitted to the IRS?

You did not send them everything they need. A "tax statement" is not a tax return. Did you send a copy of their 1040?

You need to send them a complete tax return. What constitutes complete is different for every person. It often includes the 1040, W2s or 1099s, and all relevant schedules and extra forms. If you or your wife cannot determine what a complete tax return is for you, then you can order tax transcripts from the IRS, which contains all of the information in a complete tax return.

So they (my wife and mother-in-law) need to contact IRS and ask for the tax return? Is that correct? I've sent them the W-2 forms. And since my wife is a student, that's all she got. So...I'm really confused.

You go on the IRS website and order the tax transcripts for 2009, 2010, 2011. You did not send the proper evidence. W2 is nothing but garbage without all pages of the tax return.

They both filled the I-864 form. That's ok. All I need is the stupid tax return.

I have the complete tax return for 2011 for the mother-in-law (a bit late of her to send it to me but ok). It's 80 pages! So I should send all 80 pages?! And since my wife is a student and in 2011 she didn't make more than 2000 dollars as part-time all she needs to write is a letter, right?

You must send all of it, yes, even if it's 80 pages. Remember, you get ONE TRY at this - if you are missing one thing your case will be denied. At this point, it is safer to order tax transcripts. Yes, your wife needs to write a letter explaining why she was not required, by law, to file a tax return. You should quote the relevant tax instructions. Being a student is not a reason by itself.

Do not send the state tax portion. Send only the Federal. I'm assuming that the 80 pages represents the complete tax information for the three years. They requested the current year so send them what they asked for. Anyway, W2 does not prove that you filed taxes. That's your annual income statement. You need the evidence. A simple way to do it is to call IRS and request that they fax the transcripts to you. They do it immediately. You do not need supporting documents with IRS transcripts. All the best.

They do not need to order tax returns. They need a copy of the transcripts and that is free.

They are requesting only the most recent year. Give them what they request. The other years are optional. You only need to show that at the interview, if you get one, or if your current income is extremely close to the poverty guidelines and the previous years helps to strengthen the case. Right now they asked for the current, so give them the current.

Complete Federal tax does not take into account the state taxes. They are different. If you notice, when you file taxes you receive the federal tax refund and the state refund. Also, the instructions inform you not to send the state tax portion simply because it isn't federal taxes. So are you saying that the most recent tax return for the previous year was 80 pages in total? My 3 years was 20 pages!!

I don't know. I'm extremely confused. This is all new for me so I have no clue what that is. Yes, it's 80 pages. I'm guessing it's because she worked 3 jobs. I don't know.
