on the 1040X it says to put your husbands info if filing jointly, which we aren't...so i'm assuming i still write it and then put NRA under social security? i'm assuming this form isn't as die hard obsessive as all the NVC and USCIS forms :bonk::hehe:

I haven't actually seen the amendment form, so I'm not sure. My guess is that you should just put his name and address (or whatever they're asking for) and NRA, as you said. That should be all you need, though you can't claim him as another exemption because you can only do it if he has an ITIN.

im not arguing, i'm just frustrated as everyone else here is at various points in this long process. i'm going to many different avenues, and trying to figure out the right thing to do, i'm not trying to degrade anyone here or asking for anyone to change my mind, just asking questions and having a healthy flow of idea. if you feel that it is wrong for me to ask, please remember that this is a free forum for questions and support, which is what i'm doing, please don't read my posts if they offend you. Thank you everyone for your ideas. After all of your suggestions and the phone call i just made to an irs status specialist, i am amending my status. it will take 8-12 weeks, so hopefully, i will get it in time for the interview. if not the letter will have to work.

I understand everyone is frustrated and tired of this waiting process. However it seems like you come here seeking validation of what you believe to be the right course of action and then when people advise you to the contrary you argue with them and you just come across as unwilling to accept the advise. Which is perfectly fine, this is just a forum and no one is bound to following any advice from anyone.

What you must understand though is what is at stake here. We are in a process where we are waiting to be re-united with our loved ones and our lives are on hold until then. And standing between us is an agency that has assumed that every case is to be treated with suspicion unless proven otherwise. There are people who will be handing out their judgement only based on their opinions without any accountability. Therefore you cannot just assume that since you are right and you believe that tehre is nothing really to prove that everything will be fine. You have to prepare an argument to prove that your relationship is bonafide, that there is not any fraud and the burden of proof is completly upon you to provide. I would not take anything lightly in this process and leave it so that a reasonable person will understand the situation and rule in my favor.

Similarly, no person in regular society will be able to help you much in this process unless they are familiar with the whole immigration process. since this is uncommon for the majority of people, you need to seek advice from people who have gone through this process themselves and are familiar with it or those who handle cases for people in this situation everyday and are familiar with it. You won't believe how many lawyers I have come in to contact with who claim to know the process and have given out wrong advice. Be careful in who you seek advice from as there is a lot at stake here. But the first premise here is that when it comes to immigration, we have to abandon the concept of innocent until proven guilty, we have to do the opposite and prove our innocence. With that mindset, I am sure each one of us will prepare to the best of our abilities and will leave no stone unturned and even if a process takes more effort but is safer in the eyes of the CO, it is really worth it.

Don't just follow the advice of those who follow shortcuts. That is like someone saying hey you can shoplift from this store because there are no cameras. See I did it andI got this and that. Who knows that when you try if you will be as fortunate as that person or not.

I really value the opinion of people here a lot as they have gone through the process and know it inside out. I would actually follow the advice Saylin gives me over what the agents at NVC or USCIS give me because she does in fact know more than even those who answer the phone.

I don't know how amendments work but if you were filing for the first time and applying for the ITIN at the same time, you can leave it blank and attach the W7 form with a notarized copy of your husband's passport. I am not sure if they allow the same for ammendments or if you have to obtain the ITIN first and then file the amendment.

If you are filing Married filing Separately, you don't need to specify a SSN or ITIN and can just write the name and DOB and for the box for SSN write NRA.

LOL he is an outdoors person, but I've got 4 days lol...we're going to take in the River walk at the Forks, here in town, and a few other things...but the bulk of my time is going to be just us time :) OOOO ziplining sounds fun! How was Whistler?

LOL...wow I wish! That would be an amazing deal for sure - it seems like most of our money is spent on flights for this process :)

River walk sounds really good.Ya Ziplining was fun and Whistler is very nice.Its a small town up on the hills,snow all over.We also did snow mobile.It was fun.

I know flights are getting expensive but if i find any good deal i will let you know. :yes:

AGREE 100%. I had a lawyer at the beginning of this process that knows the immigration law and also prepares taxes (Good business there) BUT when I asked him if I could claim my husband on my return or file MFJ, he said NO. ONLY if he is from Canada or Mexico due to some agreement that only citizens from these countries are eligible for an ITIN. Later, I found Visajourney, and decided to do on my own. I got my husband's ITIN on Monday :yes:

Yeah, flights are getting expensive...we've got some cushion but not TONS, and most of our flights are going to be kind of last minute bookings which is LAME. I just want to pay my bills so i can get an interview date and get the ball rolling!! But I'm a control freak sometimes, so it's all good :)

And yes, please keep me posted about deals :D

Wow, I can't believe your lawyer said that blink.gif An ITIN can be issued to a person in ALL countries, not just Canada or Mexico. Glad you dropped him ;)

For all you know, it could be accepted. You don't get an email saying they accepted your DS-261 (I never did anyways). There's been a problem with invoices bills for EP cases, so this is probably the case for you: the DS-261 has been accepted but the IV bill just hasn't been invoiced yet due to whatever problem they're having.

I want this so called number as well laughing.gif I'm trying to find a cheap flight for the first week of June, but prices are currently at $800+ headbonk.gif

I found it cheaper.the guy give my husband last minute flight from toronto to washington(round trip)in $300.Once my husband boooked $118 flight(one way) as well.

For all you know, it could be accepted. You don't get an email saying they accepted your DS-261 (I never did anyways).
