Hello everybody!

I was about to send my adjustment package in a couple weeks, but if I hold on to it for another month, me and my husband would be married for two years.

Would I be eligible for a ten year green card then or would I still only be eligible for the two year green card?

You'd be eligible for the 10 year card. I'd wait the one month and file then. Good luck.

Yeah, you're right. I think it goes by decision date. I'd double check, but either way, only a month difference. Good luck.

Hello everybody!

I would just send it in now. There's no way you'll be approved in a month and it goes by the date of approval so regardless you'll get a 10 year card. Good luck!

AOS (from tourist w/overstay)

1/26/10 - NOA

5/04/10 - interview appt - approved

ROC

2/06/12 - NOA date

7/31/12 - card production ordered

N-400

2/08/13 - NOA date

3/05/13 - biometrics appt

6/18/13 - interview - passed!

7/18/13 - oath ceremony

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I thought after two years of marriage I would be eligible for the ten year one.

I would be happy with either one don't get me wrong.

I just don't want to sent it know if I had the opportunity to file for the ten year green card two weeks later!

? People can get a 10-year card filing AOS from a tourist visa. Yes, indeed.

It does not matter from which visa you adjust your status. If you are married 2 years at the time you adjust status you will receive the 10 year card and go through the process just once. So if nothing speaks against it, give it another 3 to 4 weeks and then file. I was married for a bit over 2 years when I applied and got a 10 year Green Card. No biggie.

That's not correct. If the applicant is married 2 yrs at the interview a 10 year card will be issued, if approved. Look at my timeline. It's not about adjusting from tourist etc. It's about length of marriage that is used as a guideline for viability.

You can send it anytime from now. You have to be married for two years when the green card is approved to get the 10 yr card. As long as your interview and approval is after your second marriage anniversary, you will get the 10 yr card.

Jan 1999- F1 to USA

June 2006- AOS thru D.O.R.A.

Dec 2009- Oath. Finally a U.S Citizen
