Hello everyone, passed the interview on thursday so the Green Card is in the mail should be here in about 10 days is what she said. Funny thing is they still havent cashed the check for $1070. I know they will eventually get theres im sure. But has this happened to anyone else? I thought they cashed the check when they were taking finger prints and what not. Please let me know if you know anything.

That is exceptionally odd. Did you get the receipt that said you paid the fee?

Also the check hasnt been cashed, the money has been in my checking account the entire time.

They obviously made a mistake, and mistakes by USCIS rarely come back to bite USCIS - they come back to bite the people who filed the petition.

I suggest an InfoPass appointment. They might have credited somebody elses payment to your petition. If you don't get this fixed then I think it's possible they could come back at some point in the future and try to revoke your status saying you never paid the filing fee.

I do not recall ever seeing any sort of reciept. It was never mentioned at the interview either. If I get the green card we should be good right? Thats what your paying for correct?

The NOA1 should say "receipt" on it as well as the fee amount. I agree with Jim. While you're hoping that you can keep the money (who wouldn't!) I would think this could come back to you at some stage and it's not worth the risk. I too suggest an infopass. I don't know if you made a copy of your cheque before you sent it (I did) and if so you have the cheque number/details (I'm not sure how detailed their records are) but you can show them a statement from your NOA1 notice month showing the $1070 never leaving your account.

well, at this late stage -

if it still hasn't been cashed,

then (at an infopass appointment)

you could claim the entire casefile was submitted in error, then show the divorce paperwork you are filing.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
