HI,

My I-129F petition got denied because apparently me and my fiance did not meet in the past two years, which is untrue but i somehow failed to adequately prove that.

I researched everywhere and the best way to deal with this seems to be to refile which is fine.

My questions are if anyone will be so kind to help me out:

1)Is there anything special to refiling or just as the first and i make sure this time all the criteria are perfectly met?

2)When i filed my first one i accidentally replaced one letter in my fiance's last name instead of "Sayed" I put "Sayad". On his passport its "Sayed". Should i fix it in the second one? And explain that this is how it is on his passport and the first petition had that tiny error. And i send a copy of his passport? OR should i just fix it and not mention anything.

Thank you for anyone who replies i know they are very simple questions but you can never be too careful.

I never had to re file or anything but as far as i know when you do that you don't have to mention anything about the previous petition, make sure ALL the information is correct and triple check it all. Make sure you give lots of evidence that you met in the last 2 years, plane tickets, pictures together, receipts and stuff like that, maybe an affidavit from family or friends. since you were denied the first time, to be safe i think i would go overboard on the evidence, just send EVERYTHING you have even if you think its not necessary, worst that can happen is they set aside whats not needed

Just to double check, was your petition completely denied? Usually you get an RFE (request for further evidence) first, allowing you to submit more evidence that you did meet.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I never had to re file or anything but as far as i know when you do that you don't have to mention anything about the previous petition, make sure ALL the information is correct and triple check it all. Thank you very much for your reply. So you think i shouldnt mention it at all even in question 11 on the I-129F when it asks if you have filed before?

Yeah they did and it still got denied. But at the time of the RFE i was visiting my fiance and my mother didnt reply to the RFE correctly.

1. I've never personally refilled anything but I know for sure most of the forms ask if you have ever had a petition denied before and/or have you ever filed before. I would be 100% sure you have checked, double-checked and triple-checked all the paperwork and made sure you have amended all of these such questions.

2. ABSOLUTELY! FIX IT! Make sure your application is 100% correct, double triple check every question, every word, everything! If it's a new application without appeal, this is your second chance to get everything right.

3. I would also for your own benefit include a cover page with your application, stating that your previous application was denied because of XYZ, but then stating what you have done to remedy it.

I would like to kindly suggest that before you file again you have read every word available on this fantastic site, you can start here : http://www.visajourney.com/content/k1guide and make sure you have it all in order. It seems off that you got outright denied, perhaps you were also missing some other documentation, which is why I recommend you read through the K1 guide :dance: :dance:

Also for evidence of meeting I included as primary evidence copies of my travel itineraries, my boarding passes (keep those! :dance: ) and entry stamps in my passport. As secondary I also included about 10 photos, and on the backs of them I wrote the dates and location, who is in the photo, and just a description of what we were doing (Visiting my wife's grandmother for her birthday etc.)

Also, could you tell us how quickly you got the denial notice? How many days from when you posted off your application package until you got denied?

E-notifications :thumbs: absolutely crucial, or check your case number on the USCIS website every few days to avoid that pain.. sorry to hear that :wacko:

we got denied due to a lack of evidence without RFE and we refiled. I can´t tell you anything about the outcome of our 2nd petition yet, since we haven´t heard anything from CSC in the since august 2011, but we includet information about the denied 1st petition and explained what happened. they ask on the I-130 (i don´t know about the i129) about previous petitions. and if they do a backgroundcheck they should find out about it too. so we thought it´s better to explain what happened and why we got denied the first time...

This would explain the "I somehow failed to prove that" question and would be a critical part of your plan to change. More important than the name spelling even.

No need to say anything. Refile and attach proof of meeting this time. You should file correct information. Why on earth would you intentionally repeat an error? :wacko:

Refile the petition

This would explain the "I somehow failed to prove that" question and would be a critical part of your plan to change. More important than the name spelling even.

It's human to do so, thatz why. I just saw a bumper sticker that confirms it, which reads: :unsure:

"How come there is always time and money to do things right the second time, and not right the first time?"

I feel that if we could answer this question accurately, we could all be billionaires. :thumbs:

How did you fail to prove you met? Pretty easy.. send in copy of your passport stamp and reeipt from airline book and photo copies of entering and leaving the country alone with photos together.
