Could someone help me out with this? Won't his case have some kind of fraud marker attached to it? Also, I thought a cr1 denial needed to go through an appeals process? Could anybody with more knowledge clarify for me?

When a petition is revoked, a mark of misrepresentation is placed against the beneficiary of said petition. If the OP is going to have any hope of obtaining a visa now, the revocation decision will have to be appealed and the appeal will have to be successful. Filing a new petition would only be an exercise in futility as it is likely to be denied by USCIS. If USCIS were to approve a new petition, it does not erase the misrepresentation mark that was placed due to the revocation of the previous petition; the Consulate would see the mark and deny the visa.

me and my wife live in morocco like 3 month ago now and we get married the first time she visited me in 2010 but we was chating for 6 month and we meet online and the age different is 9 year

but we will Appeals and Motions the decision and we hope you all pray with us to get approved because me and my wife will fight for this any way we are together in morocco we just want start our life like a family with my step daughter

You will need to wait until the hard copy arrives in the post and then

In this case revoked is the same as denied. They cannot say denied because first they approved it. Revoked means they are reversing their approval. Meaning is the same: your visa is denied and there will be no other correspondence. This is final. How it works:

1) Petition I 130 is approved

2) Sent to consulate via NVC

3) CO denied visa CR1.

4) Sent materials back to USCIS. In order to close the case now USCIS REVOKES I130 petition, basically reversing their approval decision. However, they give you a chance to appeal the decision.

5) They send you NOIR. This was your last chance of appeal.

6) You appealed but was denied again since USCIS has not found substantial grounds to uphold your petition

7) They revoked permanently.

Now, what you need to do:

1) Hire a GOOD lawyer, collect all the documents and correspondence and discuss your case. Good lawyer will understand why you got denied.

2) Correct the reason

3) Apply again.

why i cant live with my wife in USA that crazy and how my wife can live in morocco with me without her daughter i think there is a solution for that because that does not make sense and no living in America for me that forever or only fr a while

You need to understand what "revoked" means. It means that your petition that got approved by USCIS (Notice of Action 2) is no longer approved. USCIS has now by all means denied it.

The reason this happens seems to be because you went to an Interview at the embassy, and the officer interviewing you didn't believe that you were a real couple. It might have a lot to do with the age difference.

When they refused your visa at the embassy, they sent the case back to USCIS. USCIS then sent you a letter stating they were intending to revoke your petition, but gave you one last chance to submit more evidence that you are in fact a real couple.

Remember. The USCIS gets thousands of petitions every year from "couples" that are only married so that the beneficiary can get a green card. In order to make sure that only real wives and husbands of Americans get green cards, they are strict on what evidence is good proof. This is especially true if your age difference is big.

The people at USCIS have never met you or your wife. That's why it's extremely important to see things from their perspective. If you had never met you and your wife.. What kind of evidence would prove to you that you were a real married couple?

What evidence did you submit? One chat log just won't do it. A chat log can easily be faked. You should have sent photos from different occasions, places and seasons, petitions from family members, maybe some passport stamps from your wife's passport showing that she has been to Morocco to visit you. Pictures of you two in Morocco etc.

Still, I'm only guessing here, because you haven't told us what the letter actually says, and you have not told us what happened at the interview at the embassy or anything.

Thnk u all for help do you all think if we appeal the case after we got the notice we have CHANC to approved the petition or it finish right now so i can find a job frome monday lol

The first step for you is to stop asking questions on this forum. We can't help you. Your petitioner needs to consult an immigration attorney with experience dealing with revoked petition approvals. You won't have ANY chance of coming to the USA any other way.

Why everybody keep saying i cant go to usa even if my wife with me here in morocco that should show them we love each other and did someone had revoked befor and they stope

We keep telling you, and you are not listening. Your petition was REVOKED. You obviously don't understand anything that just happened to you guys. Why doesn't your wife come on here? Maybe she could understand what we are saying better. It obviously doesn't matter that your wife is living there, because they still revoked your petition. Stop acting like it isn't a big deal, because it is. You have almost a zero chance in coming to America. File your appeal, but be ready to settle with your wife in Morocco. If she can't live there forever, then be prepared to have a long term relationship with her when she comes back to the states. There is no way around this, you guys need a lawyer, NOW
