I want to know if i meet the poverty guidelines for my Fiances visa to be approved? I am filling out form I-134 part 7 . In part 7 I was wondering if i put the TOTAL income or ADJUSTED income part?

My income for 2010 is 12,711.00

Adjusted income is 17,728.00

Dependent 1 Child

My mothers income for 2010 is 18,922.00

adjusted income is the same.

Dependent 1 child

My brothers income2010 total income is 10,324.00

Adjusted income is 9,605.00

Dependent 0

If i use my brothers, my mother's and mine income of 2010 which totals me to a house hold of (5) $32,712.00 125% poverty line is asking. Do I make the requirements? My mother is my second sponor and my brother would be my third sponor for my fiance. 17,728.00+18,922.00+9605.00=$46,255.00 Adjusted Income tax was sum.

Now, if i just want to include my mother's income and mines which is a house hold of (4) 27,937 125% poverty line. Would i still make the poverty line? 17,728.00+18,922.00=$36,650. Adjusted Income tax was sum.

Also, I was told that if my income of 2010 was not sufficient I can use my Income for 2011 as longest i met these beautiful poverty guidelines. The income 2011 I would have to file without dependents and my mothers and mines would be enough.

What else can I do?

What else can I do?

You cannot combine income with household members for the I-134, which is the affidavit of support you'll be submitting for the K1 visa. The form simply doesn't provide any way to do this, and no consulate I'm aware of will allow it. Either you, as the primary sponsor, must qualify on your own, or you need ONE joint sponsor who qualifies on their own.

Can you verify the income numbers you provided for yourself? How is your adjusted income substantially higher than your total income?

BTW, household size always includes the intending immigrant.

there is no adjusted.. it is your total income.

the SPONSOR's household size is the number you need to look at..

if you don't make it.. you need to find a person who's household size PLUS your fiance.. = a minimum level needed on the chart..

Timeline

I believe that the adjusted income I have is due to the oil spill money I receive for losses. Maybe a reason.

So basically I have to include my fiance, myself, and my mom(co spooner) plus the two dependents I declare as 5 in a house hold? Do I use the 100 % or 125% guide lines?

I will income 2011 next month. Can I use those taxes instead...

You have to be able to meet or exceed 125% of the poverty guideline amount. If you use a Co-Sponsor then that person will also have to fill out an I-134 as well and prove that they meet or exceed the 125% poverty guideline.

For you to qualify as a sponsor (alone) for your dependent, yourself, and your immigrant it would be $23162

Also remember they will ask to see the past three years for sponsor and/or cosponsor. And the cosponsors household size will include the immgrant.

The story is my fiancé had his interview already but he didn't get his passport seal because the documents that I send was faxed or copied. I did not send the original copies by regular mail. The officer guy gave him a list of the docuements that needed to be resubmitted. In the document it stated that my co sponsor or I did not meet the requirements. Which means that my mothers income and my mines were not sufficient. One reason I was told by a immigration lawyer was that I declared my niece in my income and so did my mother. So that really affected me. The lawyer mention if I wouldn't have put a child in my income taxes it would have been fine. It wouldn't have matter if my mom used the other child.

The lawyer mention that I can submit my income of 2011 with no children. Plus my co sponsor. I will be able to meet the poverty guidelines with out a third sponsor.

Another thing I was told that you can use as many co sponsors, there is no limit for i134.

Also, I was going to resend everything by regular mail which was going to include my income of 2010 w2 work letter and a proof of status. Original copies.

Also, my mom who is my co sponsor

And I wanted to add my brother as a 3 rd co sponsor.

I understand now that I have to include my fiancé the two dependents myself my mom brother. Which totals to 6 in the house hold....

Yes for the i864 AOS. 3 previous income taxes. I understand. Right now all I need is !i134.

So your fiance had his interview aldready and they told him he needed an adequate cosponsor?

Find someone who does.

Seems like the embassy already answered your question unless there is something else?

Incorrect. For the I-134 only 1 co-sponsor is accepted. You can NOT combine incomes from more than 1 sponsor.

Whoever told you this is mistaken. The only instance where incomes may be combined is the I-864 which is used for the AOS after you are married.

Incorrect. For the I-134 only 1 co-sponsor is accepted. You can NOT combine incomes from more than 1 sponsor.

Another new question related to form I-134 part 7 way at the bottom where it states:

"I own a real estate valued at:_________________________"

"With Mortgage(s)or other encumbrance(s) thereon amounting $_______________________________________"

Heres the deal, "if" when filling this part 7 on I134, IF someone owns a home such as a house for example is this what they mean by real estate. Also, lets say that person is not yet owner of the house and still paying it to the bank?

I guess im trying to say is if i can exclude the information out in the form :huh: ?

None of you currently meet the requirements. ONE sponsor must meet 125% of the poverty level for the household (including the immigrant). For two people this is about $18,388 and for three people it is $23,163. Even if you didn't claim your niece and let your mother do it you still wouldn't meet the requirement for two people. If your mother dropped the niece and let you claim both she would barely make the requirement for herself and the immigrant.

You will always be the primary sponsor even if your income doesn't meet the requirements. What you need is a joint sponsor who's income in and of itself will meet the income requirements for themselves, any dependents, and the intending immigrant. You can't add joint sponsors income together.

You may use any assets you have, specifically with the house you would need a statement from the bank showing how much equity you have in the house. I don't recall if assets must be 3X or 5X for the I-134.

:blink: the 100% is for active duty (military) sponsor.. 125% is for everyone else, like you
