This is probably a silly question but with all the information out there I am confused. My boyfriend of 8 years and I have finally decided to get married. We have two children together and currently live in Mexico butI work in the US. Should we be applying for the K-1? He cannot cross at the moment, we really want to get married and maybe see if he can find some work in the US but we have no intentions of ever actually living in the US because we love our home in Mexico too much.

A K-1 visa is for the purpose of the intending immigrant to enter the US and get married in the US, adjust status and then live in the US as a legal permanent resident. If you have no plans to live in the US, then no, do not get a K-1 visa. To be a permanent resident and have a green card means you will reside in the US. If you do not, you will lose your resident status. For him to work in the US, he would need to be a legal permanent resident so he would he would be legally able to work in the US. OR, he would need a work visa, and finding an employer to sponsor him would be difficult.

Visitor visa or border crossing pass.

K-1 is a single use visa. He can't use it to enter the US a second time.

Green card will not work since he will reside in Mexico.

You 2 can get married anytime you like in Mexico. If he can get a tourist visa, you could even get married in the US and then return to Mexico. If you get married in Mexico and want him to be able to travel with you to the US, then he would need to get a tourist visa(B2). I am sure you already know this is no easy task, and being married to a USC might make it harder. He will need to show strong ties to Mexico, like owning a home, family ties, money in the bank, a good steady job he has held for a few years, etc. Being in a supervisory position helps too.

If you are married in Mexico and then someday change your mind and want to live in the US, then you could apply for a spousal visa. Since you reside in Mexico, you could apply using Direct Consular Filing(DCF).

I suggest EB-5 visa for him.

I am thinking get married in Mexico, apply for a CR-1 visa as the spouse is given a green card much quicker. I would suggest taking this question to the CR-1 forum lots more good knowledge there.

This doesn't solve their problem. They will be residing in Mexico. They do not have the intention to make the US their home. The green card is for legal permanent residents of the US. He can't be a legal permanent resident of the US if he is making Mexico his permanent resident.

Exactly. They were wanting to live in Mexico and get him a green card. It doesn't work that way. You must reside in the US to be a legal permanent resident green card holder.
