now what about their father? does she have custody of the children, is the father in the picture? if he is, will he sign the permission for them to enter the US or does she have full custody and doesn't need permission from the father?

I am in step-child situation. Where is this form permitting the children to enter the US that the biological father needs to sign. He is willing to sign and we have an appointment to get it notarized on Friday, just need the form. Anyone know where it is?

It's not a form, I'm not sure if it is a letter signed in front of an attorney, a sworn affidavit.

Ok. I was asked to post as a topic by another member since I had a question in another forum. So, I need to do an I-130 for my son to immigrate with the rest of the family to the US. The problem is that I was told that he will need a letter signed by his biological father allowing him to leave Germany. Does anyone that have had their letter approve have a copy or knows what this letter looks like? Can anyone provide me with an example?

Ok. I was asked to post as a topic by another member since I had a question in another forum. So, I need to do an I-130 for my son to immigrate with the rest of the family to the US. There's no standard format. The letter is called a "quit claim". The non-immigrating parent must give their permission for the child to immigrate permanently to the United States. Something like the following would suffice:

I, (parent's name), hereby give my permission for my (son/daughter), (child's name), to immigrate permanently to the United States.

(printed name)

(signature) (date)

(legal witness signature)

(legal witness stamp)

Have him sign it in front of a notary. Get a photocopy of his ID or the bio page from his passport. That's it! :thumbs:

Sure he can change his mind, like you can change your living will or medical directive.

His challenge would be to track down the original letter he signed and switch it out for the new one. But if you want to play it even safer, add the word "irrevocable" to the mix. Better yet, consult with the notary (which in Germany is a highly accomplished and specifically authorized lawyer) and express your concerns to him.
