hi everyone. i'm unemployed. i've pretty much been unemployed my whole life. (I do my own thing ) odd jobs and all sorts of buying and selling stuff on ebay etc,before you get the wrong idea i have never been on welfare nor will i ever be on welfare. I'm also an older student at the moment

I pay $170 a month in child support for one child. My house is paid for. I have about $20,000 under my matress.

I'm going to the Philippines i'm booked for valentines day in Philippines. Now when i see my lady i don't want to make a promise to her if I can't do it.

I pay $170 a month in child support for one child. My house is paid for. I have about $20,000 in under my bed. My mother said she will be my co sponsor.

Will this work. Is there a bond i could put up for the 3 years required of financial responsibilty??

You need a cosponsor, period. If you mother's income is sufficient, then all is fine......but I believe the Phils does not allow cosponsors.

If this is true, you may be out of luck entirely.

what is your address?? :lol:

the Philippines doesnt seem to care much for co-sponsors but being a student could work in your favour. i think you would need more than 20k in savings to use that for the affidavit of support but together with any assets like your house it might be possible... maybe.

yes the Philippines do allow co-sponsor soo u dont have to worry as long as ur mothers financial statements will be enough

This is in reply to your inquiry of April 24, 2009, regarding your visa concerns.

Petitioners in fiancé(e) (K1) nonimmigrant visa cases are generally expected to provide the adequacy of their own financial resources to ensure that an alien, after admission into the United States, will not become primarily dependent on the US Government for subsistence. While our immigration law does not disallow joint sponsorships for K nonimmigrant visa applicants, the mere submission of an I-134 Affidavit of Support from joint sponsors is not sufficient to establish that the alien is not likely to become a public charge. Accordingly, we make a thorough evaluation of other factors, such as the sponsor's motives in submitting the Form I-134, the sponsor's relationship to the applicant or petitioner, the length of time the sponsor and applicant have known each other, etc. An I-134 Affidavit of Support submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has limited value. Unlike the I-864 filed by joint sponsors in immigrant visa cases, the I-134 is not legally binding and imposes no legal obligation on the joint sponsor to make good on his or her promises. Please be assured that we look at the totality of circumstances in assessing the credibility of joint sponsorships.

As a US Citizen, regardless of your income, or how you have earned a living, you must provide tax transcripts, else, you come off as looking like a tax invader. If you have cash on hand, i would recommend depositing that in an non-interest bearing account, to show you as a petitioner have some finances in your name / SSN.

Hopefully your mom has filed her taxes each year and meets the threshold for minimum earning and she is willing to document her income / job to help you out

thanks everyone. yes my mom is as legit as they come and is a retired big city school teacher.

How long do i have to show income for one year or 2 years? I'll file taxes with my income at the requirments if i have to even though i didn't make that much. $14,700 it is?? tax would be like $800 on that amount. I'll do what it takes.

$14,710 for 2 people. My child is not living with me does that count as another??

My lady in the Philippines is 3 years younger than me so there should be no reason to frown on us.

Who approves the K-1 visa? my country or her country???

The statute of limitations for the IRS is three years with ten years to collect. States vary. Some states have no statute of limitations on back taxes. You need to talk to a tax attorney to negotiate a tax settlement with the IRS, and the state in which you live, so that you don't lose your house, and that $20,000 of unreported income stashed in your mattress. Beware too, depending on your age, and if she listed you on her return, your mother may face some tax liability as well.

No. That's 100% of the poverty guidelines. That only applies for certain non-immigrant visas that don't allow for immigrant intent, or cases where the petitioner is active duty US military. For everyone else, including K visas, it's 125% of the poverty guidelines. For two people that would be $18387.

Yes, of course your child counts as another household member. You have a legal obligation to support your child. The minimum for three people is $23,162. See the I-864P for the current income thresholds.

Not really relevant in the Philippines. There are many cases approved where the petitioner is much older than the beneficiary. It's pretty common there.

Who approves the K-1 visa? my country or her country???

The US Citizenship and Immigration Service (USCIS) will accept and adjudicate your petition. The US Embassy in Manila will accept and adjudicate her visa application. The decision is entirely up to the US government, but the Philippine government does impose some unique requirements of their own. She'll have to clear the CFO office before they'll let her out of the country. Spend some time in the Philippines regional forum here for more info.

Someone who is self-employed is still required to pay Social Security taxes, called SECA, on any income over $400. You were still required to file federal tax returns with a schedule C for your self-employment income, and a schedule SE for your SECA taxes.
