First AOS denied ...remarried.............

Hi everyone,

It has been a whie since I last posted anything.I am posting to get some advice for someone that I know.

This lady initially came to the United States on a student visa.She then got married and applied for AOS.The AOS was denied.According to her,during the interview, the immigration officer did not believe that her marriage was a "bonafide" marriage.As a result,her AOS was denied.She was ordered removed from the United States in Feb 2010,however, she did not leave.

She applied for a marriage license to marry another man in 2010.That marriage did not take place.Six months later she applied for another marriage license and subsequently got married to her second husband.

She is now preparing to file her I-130 to adjust status.I have advised her to leave the country and forget about filing.She thinks that I'm being "unhelpful and negative" towards her.She visited an attorney,who advised her that she still has a chance of getting her AOS approved.I told her that I cannot see that happening.

Do you guys think that I am being "unhelpful and negative" towards her? Do you have any advice for her?

P.S. She is now pregnant with her second husband's baby.All of this happened with four months after meeting him.He is a legal permanent resident.

Sorry, but this sounds like she is marrying for immigration purposes....which is fraud. She has been married or attempted to marry three times in as many years?

I believe this is fraud and would say to her she needs to leave volutarily or be prepared to live here without documentation.

Stupid question...did she divorce the first guy?

Yeah stop being unhelpful and negative and write her a letter explaining how much they are in love....and while you are at it be sure to fill up an I-864 for her. Her home country must be horrible if she is willing to use men up (and now a child) to stay here in the good ol' USA.

Thanks for your reply! I totally agree with you.I told her the same thing.She has been married twice,attempted once.The judge already ordered her to be removed almost two years now.

She would have a tough road anyway as she looks like she is obviously fishing for a green card, but she has NO option to adjust status anyway as there are no visas immediately available for the spouses of LPRs. He must file a the I-130 for her, then wait for a visa to become available, and she must be in-status the whole time (a couple of years) to be eligible to adjust. It sounds like she is already out-of-status.

I can just say she is the most miserable lady I have ever known... The chance to got approved is next to zero, the chance for the lawyer to make good money is huge... Congrats the lawyer.

What really burns me is that she is living somewhere, being supported or working, illegally. Those aiding her ought to go to jail!!!

Yes! She divorced him a couple years ago.I was just being honest when I told her that she got pregnant too quickly,and for the wrong reasons.

Since the husband of the lady in question is LPR and not USC I am moving this thread from AOS forum to Bringing Family members of LPRs.

She better start getting ready to be kicked out of the country - once they start removal, they will get her on the plane to her home country and there's a ban that comes with it.

no you aren't being unhelpful and negative. the truth hurts. she has no chance of staying here and adjusting being married to an lpr. she's gonna get deported eventually with a baby and a ban. it's sorta sad but she brought it on herself. it's clear that she got married for the wrong reasons.

Are they from the same country? They can both move back...

I suppose once she reads this she can get a divorce and marry a USC... Shhhhh!
