Hi All, just wondering if anyone can help me with a question:

My fiance and I are starting a K-1 application, and I'm hoping to travel in February to the US to spend a few months with him before heading back home to wait out the rest of the application process. I'm just wondering, what happens if the forms and checklist arrive for me in Australia while I'm still overseas? Will it be any problem if I'm not there yet and it takes me a while to get back to Australia and take care of the rest of the application?

The approval of the petition is good for 6 months. So figure 5 to 6 months for NOA2 and then 6 months from there, you should be fine.

You will know when it is approved so figure you have 6 months from then.

Not sure how quick Australia is from receiving the info from the NVC to issuing you an interview date. The first question would be, "When did you send in the K-1 application?" If it is close to six months when you want to travel then maybe the NOA2 arrives while in the US and the forms are sent while you are here. For us the time from receipt of packet from NVC to interview was 10 days which was too fast as the medical was going to take 12 days, so we rescheduled which was not a problem for us. I will let those that have gone thru the process in Australia tell you how long the wait is. I am envious of thos people that can travel to the US while waiting for the K-1 as my wife would have never been able to get a visa so we had to wait until her K-1 was approved.

Just remember that the USCIS and Embassies do not work on your application until it is received. So the longer it takes for you to get the packet back to the Embassy the longer the waiting. Also be aware that you may or may not be allowed into the US with a pending K-1 visa depending on your ties to your home country (but that is the case whether you have a pending K-1 or not). If you are in the US when the NOA2 arrives, you can hop on a plane back to Australia and get there before the packet does as it usually takes a week or two at the NVC before heading off to the Emabssy.

Agree with the others above.

You said you're spending a few months together so I would assume the VWP so max 3 months. I doubt you'll have NOA2 by then, let alone P3. Once you return to Australia though I would get started on the stuff for P3 around a month or so later (around 5 months from your NOA1 date). The quicker you get the P3 stuff done the quicker you'll get your interview (Australia has a really good turnaround) and the sooner you'll be together for good :D

don't forget - you can download the forms and checklist - no need to wait on it to arrive via post, after noa-2.

Ok, you guys are just amazing! :D Thank you so much, Operator, Dave, Vanessa, Darnell. I love how you guys answer all my questions before I've even figured out what to ask, lol! :thumbs:

Can I just ask one more thing - where can I find the forms and checklist that I would need to complete from Australia? I was looking for them in the K-1 guide but that seems to focus on the petitioner's forms/packet and not my side of things...?

Thanks again everybody, I've been really overwhelmed at the thought of trying to wade through all this, but you make it feel doable.

click the flag under yer name, when logged in from a PC.

Then, click on the 'Sydney Consulate Information' link.

Then click on the Embassy Link, from There.
