HI GUYS, I NEED YOUR HELP BADLY. MY FIANCE FILED K1 VISA LAST NOVEMBER 2010, he made a mistakes by filling the I-129F through email, he overlooked the instruction and no one advice him that he made a mistake. it was only last week of july 2011 that we found out about his mistakes (thank goodness i found visa journey). He called the customer service and he was advised to send all the documents in Texas lockbox and she even advised him to read details here in visa journey. we we're able to send all the documents on september 28, 2011 and they receive it last Oct 6. They called him after that and they asked him to send his renewed driver's license and he was able to send it last november 3. We waited for 3 weeks for the NOA1 but we did not receive anything. Then on November 28, USCIS called him and said that the NOA1 its on its way and they said that they will pro-rated or back-dated (i dont know the term) the processing of our application to november 23 because they said we should have received it on that date. We waited until december but we did not receive anything. Then we called last week of december 2011 and told us to wait until january 2012. I need your advice on this, we need your help.

You know they have your application, patience or lack of the the story on this K-1 game. Every time we about gave up we were on to the next step. Glad you found VJ, hang in there follow the Guides and read about everyones progress. Good Luck. Look at your copies make sure all your return addresses are good. We it sent to our PMB but they sent to home mail box.

Ummm, they called him and asked for his DL? Wouldn't that be an RFE? Other members may have better, clearer answers, but this doesn't seem right at all. No USCIS agent will encourage anyone to check another website other than the goverments. I may be wrong though. USCIS sends either an email or a text message advising petitioners of our NOA1 or NOA2. They do not call, as far as I recall. I do not think your SO is being truthful. I'd ask proof of payment (the $340. filing fee). If s/he can produce a receipt or a bank statement, I'd believe this to be true. If not, your SO either sent the wrong documents again or sent them somewhere else... or simply hasn't filed.

how long did you wait for your NOA1? how come others have shorter delivery dates on their NOA1?

Ummm, they called him and asked for his DL? Wouldn't that be an RFE? Other members may have better, clearer answers, but this doesn't seem right at all. No USCIS agent will encourage anyone to check another website other than the goverments. I may be wrong though. USCIS sends either an email or a text message advising petitioners of our NOA1 or NOA2. You are in communications with USCIS and they acknowledge having your application so I would not worry too much. Just keep records of your calls

A Driver's License is not needed for the petition so something is fishy here. Also, they wouldn't tell him over the phone...

The story is fishy to me.

Renew a driver licence have nothing to do with it as USCIS never received nor need a driver license. The 2nd point is his birthday come up recently?

The driver license can be renewed when your birthday is coming up and it is valid for 4 years. I never heard that USCIS will call you on a phone number. (Unless he mean passport and not driver license)

One more thing how USCIS will know when you will get NOA1? as well most people get it in 2 weeks no more.

I also wonder how he file by e-mail? They do not mention on what e-mail address you can send application and as well in instruction no e-mail address.

From reading this story nothing add up I would put that it is 99.99% fake. (At Least for me)

Note: I also agre that USCIS would not call him and gave him update or what he need to send. At my work we had a manager who told us "Do not follow verbal instructions. Ask for written and signed instruction. Any one can say, and backup later. But responsibility will be on you as it is your signature on the paper"

If that is the case then there must be a receipt/file/reference number which appears on the NOA1. Everything relates back to that number. I have never heard of a telephone discussion of this nature or a request for a driver's licence for the petition ???

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

I know you should send him G-325A and Letter of intent to marry in 90 days.

If you did not send it or he never ask for it. I would state he did not do anything and just playing with you.

I'm kinda on your side. Driver's license is NOT part of what you submit for the package. They don't care or even have knowledge of the driver's license being renewed. And they certainly won't recommend a website, they always recommend you get an attorney. ALWAYS. You may want to double-check this information somehow.

Ok...

1) A driver's license plays NO part in ANY process of dealing with USCIS.

2) All the petitioner needs to do is provide a copy of his passport or birth certificate. Even if the passport is expired, USCIS will accept the copy to citizenship or having met the beneficiary within the prior 2 years.

3) USCIS NEVER contacts the petitioner by phone, EVER. Any request for evidence from USCIS comes via US mail.

4) USCIS NEVER recommends using any website other than the USCIS.Gov site.

5) NOA-1 arrives no later than 10-14 days after submission of the petition to the lockbox in Texas.

Sorry, but I believe something does not add up here. There have been many postings by unfortunate foreign beneficiaries where the petitioner stated that no NOA-1 was received, or that USCIS lost the petition. In the end, the beneficiary finds out that no petition was ever filed...

I wouldn't bet on USCIS having THIS particular petition.

No dear. USCIS NEVER asks for a driver's license and they don't care if your USC petitioner drives, has a license or drives without one.
