I need help! my wife immigration visa has been refused, she got the white letter stating that "you do not fulfill the eligibility requirements" they also stated that she did not have bona fide relationship. I assumed that they think that our marriage is fake. I plan to go back to guangzhou-china us-embassy to contest the case, and provide them with proof of marriage (affidavit of support letter from family and boss from work), what is your advise in regard to my plan. Thank you in advance if anyone could help with some answers!

I am sorry about the interview.

What did the letter actually say?

Is it a denial or just a request for more proof of a real relationship?

I think there are things you can do from the USA instead of flying out there now. Email the embassy and send them more proof. Ask them what they need.

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

What proof did you provide?

How many times have you visited eachother?

Any red flags (you got US citizenship through previous marriage, introduction through her family etc)?

Is she from Indonesia (flag on your profile) but living in China?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It is highly unlikely that your presence at the IV unit will matter.

You can try, sure, but GUZ IV is a high-fraud IV unit - they actually scrutinize all that was sent in the casefile.

Not send something in the casefile? is 90 percent chance it won't be reviewed on interview day, even if she has it in her hands on interview day.

You need to answer the questions asked above before we can help you, you have not given enough information.

I had provided them bona fide of marriage from her sister, pictures of us and family about 40 of them, phone records, money transfer receipt, email.

what they are saying is she did not have bona fide marriage relationship based of what went on during the interview, my wife was nervous and forgot about my son's name, instead of saying forgot, she said did not know it might be a flag for them. I did not send my passport, when she was ask for my passport she could not provide it. They said the case is being transfer to the USCIS for them to review and they will let me know once the case has been transferred and I should contact them for more information about my case. I am thinking pro-active by going there and find out exactly why was she refused to get her visa, if looks to me just proofing our marriage is real, and why not just tell us that, instead of sending the case back and forth! My Citizenship is not a flag, no problem with it, I have been a US Citizen for over 12 years now and I got it from amnesty program. So should I go there and ask them about it, will they talk to me and give answer, or ignore me and tell me to wait for the instruction on the letter when the case has been transferred to US-CIS. that means a few months later??? please advise! Thanks.

This is not the way to confront people who are trying to help you. You'll do very well to heed Darnell. Please provide the requested information so that more meaningful help might be offered.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

As TBone said, listen to Darnell, he has a lot of experience with the very difficult consulate you are dealing with. You asked him what he knew about your case and he was honest and said nothing, but he has a lot of info and ideas which could be useful to you.

- What does "bona fide of marriage from her sister" mean? Do you mean her sister wrote a letter?

- Not knowing your son's name is big. They often ask- and expect answers- to far more detailed questions, such as the name of the school he goes to, his address if he doesn't live with you etc. She is your wife, she is supposed to know about your family.

- How often have you met in person?

- Does she have a lot of family in the US? Did some of them introduce you?

You can try and contact the embassy, beg for a second interview, if they grant one, fly over. This works in some embassies, but from what Darnell says, not in China. You may need to consider canceling the petition and starting again, after another visit. Front-load the petition this time with lots of proof of meeting, emails, photos of family together etc.

I am sorry what I said! I was so frustrated about it and did not think much! Basically they are in the process of transferring my case to US_CIS for review/revocation, once it has been transferred they will notify me. In the white slip/letter the instruction was to contact them after they have received the case back. I can ask for more information about the case. Until than, they said they will not reply any question by letter or email. But In reading some feedback from other case on the internet, there has been people begging to ask information about the case and was successfully granted and was able to overcome the refusal, that is why I attempt to do that, with the hope that they will allow me to provide more bona fide of marriage relationship. In regard of the bona fide of marriage from her sister, yes that was a letter stating that we got married. I had only visited her 2 times. first visit we found each other attractive and after a few days, after meeting her family and getting her parents approval, we decided to get married right away, the second visit I took her to meet my mom, brothers and sisters, and I have pictures of every one together. I realized that she made a big mistake not able to answer my son's name. I just want to make a point that we are indeed married for real and give them more proofs of our marriage. at this time some more pictures and bona fide letters from parents, her boss, and her niece that spent more time with me and my wife during my first and second visit. Any input or advise as far as other means of proof to give them. any help will be appreciated. Thanks for your help! PS: I just hope I don't have to start over from ground one. if you are 100% sure that there is no hope or point of going there begging them to give me a second chance. please say so!
