Hi Every one,

I just have a quick question, my wife came here with a K-1 visa and we got married, still she is on conditional green card. during our marriage, she had a medical condition which she was out of control and I had to call police, but they arrested her for Assualt and battery but later or she got admited to a hospital and charges got dismissed immidiatly.

Now I'm wondering what should I do for lifting condition from her green card when I'm ready to file for her?

YOU don't do anything. SHE is the one applying to life HER conditions.

You can help by helping her collect evidence of relationship and then you must attend the interview when/if there is one.

Not trying to get too personal here, but where is your wife now? Is she still in custody, or in a hospital or whatever?

As Vanessa&Tony said, it isn't you who files, it is HER or the both of you jointly. But it can never be just you, the USC.

Question number 7 on the I751 is where you'll need to mark "yes" and if you look at the instructions for that form, it explains which documents you need to include with the application. If the charges were dismissed, then I guess that would be a disposition, or a statement from the arresting authority explaining that the charges were dismissed and why. In this case, official documents from the hospital would probably also be in order. Read though the instructions and see which option fits your case.

If your wife is not currently living with you then you'll need to provide a lot of other documentation about the situation, I would assume.

Should I send Court Docuements too or just keep it incase if the ask?

You DEFINITELY need to send court documents, but I"m not sure which ones. Again, read though the instructions on the form and it will be explained much better.
