Hi, I am new here and started browsing the site for possible similar case that I have with me and my wife. Unfortunately, I cannot find one.

My wife is here on a B1/B2 (which she had even before we met as she traveled back and forth to the US a lot). We got married just over a month ago and we are working on AOS for her and hopefully, file a petition as well for her children who are abroad. So here are my questions:

1. Is it better to process her green card first before we process that of her children or we can file all petitions altogether. We are hoping for the children to be here before start of school year next year. If we can file for the children at the same time, do we only have to send I-130 for her children (ages 8 and 10)? Or what other forms need to be submitted for her children?

2. I have read in some threads that they got notification for medical exam. However in other threads/guides, it says we have to file the AOS with I-693. This is quite confusing. Do we really have to submit AOS package with I-693 or we leave it out until we are requested to do so?

3. My wife is 42yo and the I-693 requires immunization that she had taken some 20 or more years ago. As much as possible, she does not want to have those vaccines again. However, we are not sure how we can provide proof of her immunization. She said she does not know who the doctors were anymore. She just knows she had them as confirmed by her mom. What do you suggest we do?

You need to send your I-693 (in a sealed envelope - as provided by Civil Surgeon) with your AOS package. Otherwise you'll get RFE and it will likely cause delay. You may seen notifications for a visa process, which your wife's AOS has nothing to do with.

Hello tentmaker, your wife will definitely have to get the vaccinations because USCIS wants them current. They won't accept 20-year old records, (I asked and was told that the vaccinations need to be less than 1 year old) so you might want to get her started on those.

Hi, tentmaker, congratulations on your marriage! I will let other, more knowledgeable people comment on the children question, I do not have a clue. However, for the medical exam, it is best to submit it with your AOS package. If you don't, they will issue an RFE for it, and that may delay your case. As to the immunizations - I phoned to the main office of my health district in Canada, and they sent me my records (from 40 years ago, I am also 42 years old). It was accepted by the civil surgeon I saw no problem, I did have to have one booster, though - Tdap, I think.

I remember seeing a thread from a former adjudicator that they usually prefer family petitions with little kids as this would earn them more credits. I am just not sure if that will apply to our case since my wife is now here while her kids are abroad. This means that we can concurrently file I-485 and I-130 for her while we file I-130 for her kids.

On another note, both her children have multiple B1/B2. Will it be good for her to just go back to her country as soon as she gets her Advance Parole Document and come back here with her kids then process their papers?

Thanks Valerie. Good to know that they will accept immunization records of years ago. My wife is now checking if it is possible to get her health record from their health dept. She doubts it as their country is probably not keeping health records the same way your country does :( We'll see.

I am not sure if I can or should file petition for my stepchildren who are abroad at the same time that I am filing AOS for my wife who is now here in the US. Or should we wait for my wife to get her green card before we file for her children? Please help. Thanks!

Sometimes I guess its just me when I read cases like this how can ppl make a decision on fly to get married when they have children living in home country.

You and her both know she will not be able to go home until her AOS process is complete.

You cannot bring her children on B1/2 and file for AOS - that is visa fraud.

your wife cannot file I-130's for her children until she has her green card. you can file using step father relationship. as far as the timing of the filings, I'm not sure. it would be best to consult an immigration attorney. with your wife, you already have the burden of proof at her last entry into the USA, there was no intent to marry and immigrate.

You can file for them now as a step parent. Or your wife can wait for her green card and then file for them. Bringing them on a tourist visa and adjusting with intent is not an option. Is their father involved, and if so does your wife have permission to move the kids to the US?
