Hello everyone,

I really need some expert advise. My engagement has been disolved and I wish to withdraw my petition. I am still waiting on the second NOA and am not sure if I should wright now to USCIS or wait until I get the second notice and not to take any action. My primary concern is what information is sent in the packet to my former fiance. Particularly I am concerned about my personal identification number such as my ss # getting out. I thank you in advance for your advise.

if you're 100% sure not going ahead with it (you can't undo a withdrawal request once approved), write to USCIS right away with your request and reason. attach a copy of the NOA1, send w/delivery confirmation.

as for your ss#, ask yourself this: is your fiance/e computer-saavvy, very educated, a business person, knows about creditcards? this should give you an idea of the likelihood that you'll have problems in the future. hopefully from your papers will be disposed of safely. just keep all infomation you have about your fiancee including pictures just in case.

'sent in the packet' -

why - NOTHING !!

--she doesn't receive any packet from the receipt notice - that's for the petitioner.

--she doesn't receive any packet from the approval notice - that's for the petitioner.

--she doesn't receive anything from the Embassy with your SSN on it.

--after I-129F approval - there's a bevy of forms that she must submit to Kingston - one of them will have yer SSN on it. She must fill in that form, so she'd have to have yer SSN already.

--your SSN is on the I-134 submitted on interview day.

So, unless you gave her a copy of YOUR G-325A that you submitted into USCIS, you should be 'ok'

as for 'how to withdraw' -

You've a receipt notice - the I-797-C formletter. It has a correspondence address on it. Send in a letter to that address, with a copy of the receipt notice.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

send the request to with draw/cancel now before the approval of the case.. you can use the first NOA letter received.

you are identified my name, birth dates AND case numbers. They dont ask for much of anything else. Are you keeping the petition based on info received?

I would call USCIS right away and tell them that you want to withdraw the petition. They will instruct you on exactly what to do :thumbs:

Yes I believe you should send a request in writing to withdraw before your NOA2!

because the petition has never been approved you would need to contact USCIS and ask to whom would you direct you letter to requesting withdrawal of your petition.

You can put a lock on your credit bureau file so that if someone tries to get a credit card in your name etc, the credit bureau cannot be accessed without you giving out the PIN.

If you are certain the relationship is over, simply send a letter to USCIS indicating you "hereby withdraw the petition". No reason is needed but you might want to simply state the relationship has ended. Nothing in any packet from Kingston will contain your SSN.

Withdrawal prior to approval will assure there IS NO packet 3. An attempt to withdraw after approval is doable as well but by contacting the Consular Immigrant Visa Unit in addition to USCIS.

Facts are cheap...knowing how to use them is precious...
