I came to the us 2 weeks ago on a k1 visa, we are planning to get married on dec 16th, my question is, do i file for ss before i get married (with my maiden name), or after, with my married name??

Either way is supposed to be fine, however, some people have had troubles getting the SSN after they are married. They are either told they cannot do it based on their K-1 anymore, or because their name no longer matches the name in the database and their I-94. This is due to SSA workers being ignorant to their own rules and not knowing their own jobs. You might want to go file for the SSN in your maiden name before you get married and have it changed to your married name later.

Its better to get it before marriage. Sometimes the SSA won't give you one after marriage (even though they're supposed to). Go to the SSA tomorrow and apply for it. You don't need it to get married but it means you can start opening bank accounts and other stuff. You can go after the wedding and get it changed (and again sometimes they have issues with that as well but at least you HAVE the card). If they won't let you change it then, you can wait till you get your EAD.

SSNs and marriage are totally different things. No need to wait to do either; can do either one first.

thanks guys! I think I will go today to get the SS. Hopefully I will be able to change it after I get married. If not, then Do I have to file AOS and EAD with my maiden or my married name?

Your SSN doesn't matter for AOS. You put whatever name you want on your GC on the forms. My SSN was in my maiden name until after I got my GC (in married name). I changed my SSN several months after getting my GC.

If the SSN is important to you (need it for health insurance etc) then definitely get it before marriage. There are far too many threads about SSA's not knowing their rules and saying that marriage changes your eligibility (it doesn't).. and while you CAN fight it, it took some people so long they ended up past the deadline to apply for the card.

Chinook and I were K-1ers. Chinook applied for her SS number in her maiden name about a week after she arrived in the U.S. and received her SS card about a week later.

Having a SS number helped us with her AOS. With a SS number, she was able to add her name to my bank account and to open up her own bank account. She was also able to add her name onto my utility bills. It also helped her get a state ID card which showed our common address. Those are some of the things we used as evidence of a bona fide relationship when we filed for AOS.

A few days after we were married, we got a copy of our official marriage certificate from the county, went back down to the SS office, and Chinook filed to change the name on her SS card to her married name. She received her new SS card about a week later. At the time Chinook received her SS card in her married name, she still had about 30 days remaining on her I-94.
