You have to read the instructions for the I-765 to understand which category to file under.

The answer for a K-1 is ( c )(9)

Actually you're wrong about one thing... K1 is a different number. AOS is C9 and that's the number they put.

What exactly am I wrong about? Not sure I get what your point.

Any K-1 EAD application (other than for a replacement) must be based on a pending application for adjustment under (c )(9).

I suggested (c )(9) as the answer in my response to the OP's question.

No it doesn't. K1's are eligible for EAD's prior to AOS and the code for K1's is A6 (seriously, have a look at the instructions). ANY AOS application (including from visitor visas etc) uses C9.

You stated "K1 is C9" and I said you're wrong. K1 is A6 (this is if you want one prior to AOS, you have to pay for it and it's only valid till your I-94 expires). AOS is C9 and the OP is getting their EAD based on AOS they put C9. You were right about what to put, but wrong by stating it's for "K1".

Yes, for the OP, who is apply for AOS the number is C9 (as I said) but the person I was correcting said "for k1's it's C9" but it's NOT C9 for K1 EADs!!! K1's are eligible for EAD's PRIOR to AOS and use a COMPLETELY different code (A6). The statement SHOULD have been "For AOS it's C9". Doesn't matter if it's a K1, or a K3, or a tourist visa, or VWP... as long as they're AOSing the number is C9. NOT because they're a K1.

As I said, AGAIN, its C9 but the statement that it's the K1 code is wrong.
