Hi, I have a family friend working as a welder since December 2006. He was recruited through an agency in the Philippines and was given an A2 Visa (Business permit good for 5years) at the time, until last year. He went back last year to PI and was given a 2 year extension I-94 Visa. So, basically he's been living here in Texas for 5 years and will be going on 6 years (2012.) He's been with the same company/agency ever since but he did not have a specific address or even a PO box number on file but uses his work address as his “address.” He said, “he goes to different job sites around the country a lot to do his work.”

So, the question now is there a way for him to get another extension; perhaps another working permit; or maybe something else? It's really a shame with all those years invested already, he just had to go back to the Philippines again. Also, it's too bad that he wasn't able to find an USC wife to marry, as he is still single. Thank you so much in advance for any help we can pass on to him! Have a good day!

09/27/11: Case completed file shipped to USEManila; arrived 10/3

10/13/11: Medical passed/completed today but still NO interview date yet?

10/16/11: Called USEManila file ready! Called Appt. Services set up Interview Date for 11/9/11.

11/09/11: Interview. But had to comply with 221g, re-verification forms CENOMAR/NBI.

12/02/11: Visa approved but delivered 12/7/11.

are you he has an A2 visa/business permit? if you go to travel.state.gov, A2 is for foreign military personnel or if it's just A that means he's been working for a govt agency which from your description doesn't seem like it.

Ooops! Let's do this over... you're right Zen Den, it's supposed to be E2 Visa. So, please just erase erase – the a2 to make it look like E2 Visa. So, what's next? Thank you very much! :bonk::help::wacko:

Why did he only get a 2 year renewal?

Well, according to him that's all they could him a maximum of 2 years with the I-94 Visa. This is after taking a two-week vacation in the Philippines last October. Again, keeping in mind the E2-Visa is also about to expire after being here since 2006.

E2's can be renewed indefinitely. so all his Employer would need to do is put him in for another 5 years.

Sounds like the I 94 was just for 2 years to take him up to his visa period.

It is always very difficult when info is second hand to comment.

Great... thanks Boiler! Yes, the E2 visa was issued Nov. 27, 2006 and will expire on Nov. 20, 2011. The I-94 will expire on Nov 5, 2012. Yes, it's really difficult when info is pass in between but we'll do our best. Anyway, from the history of his employer it's looking like the other workers who had an E2 visa with them was never renewed but only a few. I don't even know if there is time to get an extension now with less than a month before his e2 expires. So, that's why he is looking if there is another way to get a working permit and work for a different employer or just another type of visa, perhaps? Thanks again for your help we really appreciate it! :thumbs:

That makes more sense.

He is on a temporary work visa. It does not really matter that much what it is.

His visa is dependent on being employed by his current employer.

So either he stays with that employer or finds another employer prepared to sponsor him for a work visa. The E2 is very specific, unlikely to be another E2.

I would have thought it is going to be a very big ask in the current economy.

Although, he went back last year to PI for two weeks and was given a 2 year extension I-94 Visa and will expire on Nov. 5, 2012. No, don't get me wrong I am happy with the information and really do appreciated - Boiler. Although, I'm not thrilled with the number of traffic from that forum?! But like I said, on this post "I would really like to hear from the Philippine Forum if they have a similar experience!" And yes, I do expect "something different" will come up with this post... never say never, can't hurt a bit?! Thank you very much! :thumbs:

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
