We have a cosponsor who is about $3,000 short. Is it possible to still use this person? My husband has over 20,000 in savings, can this make up for it? I know on the form it asks for the immigrants assets.

A spouse's assets can be used, but only to make up the difference for their USC spouse and not for the co-sponsor. You need a co-sponsor that has 125% of the poverty guidelines for their own household + your spouse. One that falls short will not work. You need to find a new one.

The possible co sponsor I was talking about is seperated from her husband, but not divorced, they don't live together anymore, but he was in her 2010 taxes, does he still count as someone in her household?

How much does your husband make at work? You can use assets to make up the difference, but they must be 3x the difference. For example if your husband is $1k below the poverty line, he needs $3k in savings. So whether or not your husband's savings are adequate depends on how short you fall.

Yes. She's still counted. You'll notice there's a "married" box and it doesn't say "are you currently married and not separated? Then tick this box.".

As for income. The income amount is $18,387. If using assets you need three times that. If using a cosponsor the cosponsor needs to make enough for THEIR household size plus the immigrant.

There needs to be 3 times the amount you fall short of the 18,387. If he has 20,000, then that is enough to make up for a shortcoming of 6,500(times 3 is 19,500). So, if you make around 11,800, then his savings could work.

Yes, kids count in the household size. Any and all dependents must be counted in household size.

Your husband doesn't count in her household count. Your Aunt's household count will be HER family (husband, kids etc) plus the immigrant.

Doesn't matter. Any kids under 21, no matter where they live or whether claimed on tax returns count in her household size.

So her household count is 4, plus the immigrant. She should complete an I-864 and then to include her husbands income he would complete an I-864A.

Based on using both of them, you have 5 people: husband, wife, 2 kids, and your spouse (the immigrant). They need to make a minimum of $32,713 to meet the federal poverty guidelines of 125%, unless you live in Alaska or Hawaii in which case it is higher. So, yes, if they make over $32,712 they should be fine.
