For my fiances medical he checked off the box that he had not misused or abused drugs. He thought that he was answering honestly because he considered abusing drugs as currently using them and relying on them. In the past he tried ecstasy experimentally, once, when he was 17. From previous medical records that we also sent in for his medical it does state on there that he has tried drugs. He got a phone call today from the Medical office asking why he lied and that could cause us not to get out visa. He explained everything that I just wrote above. They said that they would keep in touch, but according to my fiance the lady on the phone didn't seem very happy.

Will this keep us from getting our visa? I read somewhere about a life ban from the US is this true? For something he did once when he was 17? I'm just confused. Does anyone know anything he could do to possibly help the situation?

Thanks

So what kind of other questionnaire did he fill out were he admitted it ? I would advise anyone anywhere who did something like that when they were young to never ever admit it ever, on any document --immigration or otherwise. In my opinion it's irrlevant to anything and what he did in the past is nobody's biz.

When I joined the army years ago, it was standard to ask recruits if they had ever smoked weed or used drugs etc. I think they used that question to rule out the people that said yes, for having bad judgement.

Your fiance could have potentially opened a can of worms for himself by divulging a prior history of drug usage.

Typically a lifetime ban is only administered with convictions of drug possession, but the Consulate has the absolute right to deny a petition for material misrepresentation such as lying to the medical officer.

This could potentially cause problems.

"Does anyone know anything he could do to possibly help the situation?"

The only option your fiance has is to be completely honest with the Consulate at the time of the interview. Lying will make the situation worse and will cause a denial based upon a material misrepresentation.

If I were your fiance, I'd obtain as many character references as possible from co-workers, employers, friends, etc to show the Consulate that his actions at age 17 are not his actions of today. The Consulate still has the ultimate decision making authority but letters of character reference might help him.

I had a thought... what if you had a blood test done to show he hasn't used any drugs and have it notarized.. And have the statement say when the last time he used anything. Have it ready to take with him to interview or to have it ready if they require more information.

Not sure if that would be suitable or not. lying is never the best way to go into this.

Thats a good idea. He's had so many blood tests that obviously there is nothing in his system... especially since that was 5+ years ago. But it wouldnt hurt to get something notarized. Defo going to tell him to get lots of character references as well. Just going to have to prove that he is in no way a drug addict or abuser.

Blood tests don't prove anything and notorization only prove the authenticity of a signature.

The reason blood or urine tests won't don't do any good is because of the half life of drugs.

For example:

Cocaine - out of the blood stream 24-48 hours after last usage

Marijuana - out of the blood stream 14-28 days after last usage

Barbituatates - out of the blood stream 3 days after usage

Opiates - out of the blood stream 72 hours after drug usage

All a blood test will prove is that the fiance hadn't used any illegal drugs for 2-30 days prior to the interview. Not a convinvcing statement to the Consulate.

Character letters from the people that know yoru fiance best are your best shot at a positive outcome for his interview.

Yeah he has had so many blood tests this year with the cancer stuff and through the medical and they have that. Just willing to do anything to help. We will get tons of character witnesses from close people. and Dan, yes I know I was looking forward to all of us seeing each other!

So do you think we will at least get the interview? or can the deny it before it even gets there?
