NOA2 Still Not Here... Is There Anything I Can Do?

Timeline

I know I should of not made that VJ timeline... because now I'm really worried on why my NOA2 (NOA1 on April 26, 2011. Timeline states my NOA2 should arrive on August 23 to September 5) has taken so long to process while I've seen late May filers received their NOA2 from Vermont Service Center (Just think it's also unfair how California Service Center filers always seem to get their approvals within a few short months, while VSC filers end up waiting 4 months or more. Should all be consistent, but guess not.)

Anyway, I check my status at least a million times a day. I signed up for email and text notification, etc. I even called the 1800 number a million times just to hear my case status tell me that I received my NOA1 on April 26, 2011. I even called 202-663-1225 and the guy just stated that my case is still in initial review and that only approved petitions are suppose to call this number and that to call USCIS for case updates.

Should I call my Congressman to help speed things up, if it's even possible or just waste of time at this point of time? Should I try to get an live operator on the phone when I call USCIS to inquire on my NOA2 or will they simply just tell me that processing times are 5 months and I should wait till 5 months is over to call them again or have a stroke... whatever comes first.

I know I maybe over worrying and probably look dumb if my NOA2 arrived tomorrow, but man this visa process is so freaking stressful! I feel your pain to all who are still waiting on their NOA2 after their timeline dates passed.

this process is horrible indeed, because your life is put on stand-by. but the timeline is not as accurate as you think. CSC approves people faster cause they have less petitions. now, noa2 can vary from 2 months to 9 months (seen a lot of cases) after noa1. calling uscis often might put you on a black list. i advise you to just wait, cause theres nothing you can do about it. when you reached your 6 months wait and still no noa2, only after that you can call uscis.

I emailed my US Congressman and plan to meet with his local staff next week as well to discuss my problem. I just feel that it's not fair that our case has to wait that long when many April and May cases have already been approved and they are now starting to approve June filers.

I looked over Igor's list and I find that people who filed the last week of April half have yet to receive their NOA2 or simply didn't update their timeline, so there maybe a reason why our petitions have not been approved yet. Maybe our stack went to someone who is slow in processing, but who knowssssss.

and yes the process is horrible. I don't mind the rules, I just hate the wait and knowing that my future with my fiancee rests in the hands of other people. I just find the whole process down right scary.

I am in those same boat, it just sucks to have your life on hold until somebody in Vermont decides to look at your file. It is even worse when you see people that filed later to get approved.

My life sucks right now, I have to be strong and show my fiancee that everything is fine but I can't stop looking at Igor's List and VJ. Hopefully we can get our NOA2...

Look at it this way. If everybody else got approved after 9 month but normal processing time at USCIS is 5 months as their goal you'd still be looking for NOA2 at the 5 month mark. When petitions get approved before that mark you start looking at those approvals which can be a devastating to do for some extra months - or even just weeks.

My point is that your 5 months are up September 26. You can call USCIS beyond that time and make and inquiry about your case. They'll peobably ask you to wait additionally 30 days. But before the 5 months there is ever so little you can do.

Right now, 30% from the Vermont K1 April filers are still waiting for their NOA2s.

Hang in there : ) Do a bit of bowling on skype/yahoo, watch a movie together, research about marriage license( it's getting closer to that day. Happy thoughts, hey!), take pictures of things/places you'd adore to show your fiance. Focus on what you already had together before inviting USCIS for a cup of tea.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Click timeline or "about me" for all details.

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

I completely hear you and all your frustrations about this process. I too am stressing out wondering why I haven't heard anything. I got RFE on July 29th and returned info asap, but I sent it through my attorney ( which was and has been a huge mistake, cause he drags the process out by weeks each time) who didn't get the info into the USCIS until Aug 22 when I received notice that they received my evidence and now again under review. I am waiting on my NOA2 ( which has been 33 days today) and then firing this damn attorney. He has cost us at least 2 months from the time we hired him in february and started this process. He dragged things out so much he didn't get the I-129F filed till may 9th.

This visa journey seems to be a all consuming thing for sure.

Hang in there, we have a great group of supporters here at VJ and they feel our pain.
