he told me that he talked to his lawyer and that he is able to cancel it.

Then, You Don't Need Him. Why go through all that and in the end get a Lawyer to breck-it-off. If he Consultaed a Lawyer to discuss ending a Marridge before you got Married then God Loves You and pray to him for the Advance Warning. Hugs !

The petition isn't closed when the visa is issued. It's closed when the visa is used to enter the US. The petitioner can still withdraw the petition.

The OP can return to the consulate and have the visa cancelled. The consulate will simply stamp the visa cancelled and enter the cancellation into their computer system. The visa itself should not be removed from the passport. You should never intentionally remove pages from your passport.

Kamilla, if you intend to apply for a student visa then you should probably stop communicating with your ex-fiance. An accusation of visa fraud against you may cause problems with your future visa applications.

he is able to cause a lot of trouble for me, he even threatened me that he can write a letter to embassy and claim that it was a fraud case, that means i only want to come to US , not to be with him.

I won't judge you. But you need to pursue canceling the Visa so it don't interfear with a posible student Visa. If your ex is threatening you with immigration topics against you. CUT OFF as much as posible as far as Communication as to: he could save and use against you. SO WITH THAT SAID: WHAT COUNTRY ARE YOU FROM ?

Kamilla, the best advice you got is from Jim "What to do Now".. Cancel the Visa and END Communication with this Ex. Period. It is a threat to your future.

Of course he can accuse you. If he has evidence to back up his accusation then the US government may conclude you are guilty of visa fraud, and a finding of material misrepresentation would be entered into your case file. You'd never be able to come to the US again. On the other hand, if he doesn't have any evidence (which is likely) then his accusation would be entered into your case file, but the US government wouldn't draw any conclusions from that. However, a consular officer who is interviewing you for another non-immigrant visa would see that accusation in your case file, and they would be free to consider it when making the discretionary determination whether to grant a visa to you.

The consular officer has a lot of discretion in most types of visa cases, and they can give any derogatory information in your case file as much weight as they think it deserves. You'll be much better off if there is no derogatory information in your case file.

So this means to me Kamilla. Cover your Butt. Hard to accuse you of Visa Fraud on a K-1 if you Willfully declined it and never entered the US. Declined the Visa on your own and free will. Your reason maybe asked. I would say prior mental abuse. MENTAL ABUSE is threats, overpowering authority and fear.

that is a wrong idea to let the visa expired itself,even your benificiary or petitioner it doesnt matter who u are u have a responsibility to call,send a letter or visit the embassy for yur visa cancellation,u need to let them know considering that you are planning to go to US again,ive been in your situation before,you need to go to embassy where they issued u a visa and they are going to put some stump on your visa like"cancelled w/o prejudice"some knd of stuff..so u dont have any problem when u re apply another one.okay??

so now get your a** at the embassy and make it clear,sorry to hear abour your story

Contact the U.S. Embassy that issued the visa and explain your plans to not use it. Ask them what you should do, especially since you have plans now to obtain a student visa. Also, let the embassy know that this was a decision that you took to end the relationship and that there is nothing you have done that would preclude you from applying for any other type of visa. If you must, mention the threats by the fiance, but that probably won't be necessary. :thumbs:

Tear the visa out of your passport and send it in with a notarized letter asking them to cancel all.

the above is not good advice. the passport belongs to the country, not the individual, and the individual is not authorized to remove any part of it for any reason.

we finally decided to end this relationship. it was hard for both of us specially after all we've been through. even now I have the visa in my hand but we cant continue anymore :(

should I write a letter or send an email to the US embassy and ask to cancel the visa? and mention that I wont come to US

As I am the alien fiancee, is it my responsibility to write any letter , if so what should I write?

I'm planning to come to US via student visa, and becoz of that i should avoid any bad reputation. do you have any idea what should I do?

If i know only petitioner allowed to cancel k1 visa.... it is base on my expercienced...i talked to our lawyer and request to cancel, and our lawyer said, only petitioner can cancel....im glad my ex fiance he finalize to cancel by the request of lawyer... thanks

Wow, its so sad to see you make it to the end and have to give it all up. Here I am just days away from starting my journey. I hope you considered every option with your significant other before going through with this. You don't know how lucky you are to have made it to the end, don't throw it away for something you will regret later on. In any case God Bless !!
