my son and i got here in the us last july 2 and married an active duty member of usarmy. thing is we cant seem to make them approve our benefits such as deers and other us army family benefits such as command sponsorship because i cant give them a document stating that he is under my full custody under the philippine law given that i had him out of marriage and never married his biological father but he signed his birth certificate but never stood for his responsibilities since then.. i dont have any way to contact him and i think its better that way..please help me

Its not they are VERY picky.

OP I hope you can figure something out to get them off your back and get the benefits for him.

i thought so too.. the us embassy was very keen about it about child abduction and such and to prove that he is an illigitimate child alone should be enough.

thank you.. this is stressing me so much given the fact that i cannot financially help my SO yet and the benefits could help the family go through a lot.its not that he is seeing this as a problem having my son ( ours now ) to support,he is a good man its just that i really feel bad about this whole thing and for having him to get through this very complicated situation,my situation wasnt very unusual back in the philippines tho

What is wrong with marrying a woman with children?? Some i know married a womanwith more than 3 kids even.

Do u have the solo parent id from DSWD? That will help support as proof that u was raising ur son alone without the biological father's support.I am not a US military wife but sounds like u are asking for full custody proof.

They're not saying there's anything WRONG with it, just that they couldn't do it. And I'm sorry but I feel the same and so does my husband. We're just not at the "kid" stage of life yet, and not ready for that responsibility. I DO admire those that do though.

Did you have to show anything to USCIS? There's gotta be a way and I'm sure you'll find something. Maybe you could get something from the Philippine embassy about it? Or maybe they know someone who will know something? There's a military helpline somewhere I thought. Surely you're not the ONLY Filipino with a kid married to a USC... did they offer ANY suggestions?

Your DEERS center and CaC card issuing facility are wrong. The approved K2 and I94 are all the military needs in addition to your marriage documents. My stepdaughter came here in July 2010 on a K2 visa and had her full deers benefits in less than one week. They used the Alien numbers(s) in lieu of social security number to issue their CaC cards. She was on TRICARE thirty days after CaC card was issued, as that is the minimum requirement.

This is exactly correct, there's nothing wrong with it at all and in fact i applaud the man for taking on such a responsibility but i guess some people read English differently than others.

Go talk to JAG about it, as they'll have the regulations available that you can have printed out to take to the DEERS office. Other than that, maybe approach the Philippine Consulate about a letter that indicates the applicable custody status of illegitimate children in PI or, if it's available online, print out any legal regulation that governs it.

Well..u maybe right..u may be right some ppl read English differently than others. :wacko::rofl:
